60-Day Notice of Proposed Information Collection: Family Unification Program. The Family Unification Program (FUP) is a program, authorized under section 8(x) of the United States Housing Act of 1937 (42 U.S.C. 1437(X), that provides housing choice vouchers to PHAs to assist families for whom the lack of adequate housing is a primary factor in the imminent placement of the family’s child or children in out-of-home care; or the delay in the discharge of the child, or children, to the family from out-of home care. Youths at least 18 years old and not more than 21 years old (have not reached 22nd birthday) who left foster care at age 16 or older and who do not have adequate housing are also eligible to receive housing assistance under the FUP. As required by statute, a FUP voucher issued to such a youth may only be used to provide housing assistance for the youth for a maximum of 18 months. Vouchers awarded under FUP are administered by PHAs under HUD’s regulations for the Housing Choice Voucher program (24 CFR part 982). Affirmatively Furthering Fair Housing: Re-Opening Public Comment Period on Subject of Later First AFH Submission Date for Certain Entities: Through this rule, HUD proposes to provide HUD program participants with more effective means to affirmatively further the purposes and policies of the Fair Housing Act, which is Title VIII of the Civil Rights Act of 1968. The Fair Housing Act not only prohibits discrimination but, in conjunction with other statutes, directs HUD’s program participants to take steps proactively to overcome historic patterns of segregation, promote fair housing choice, and foster inclusive communities for all. Streamlining Administrative Regulations for Public Housing, Housing Choice Voucher, Multifamily Housing, and Community Planning and Development Programs Proposed Rule.  Section 243 of the Department of Housing and Urban Development Appropriations Act, 2014 (2014 Appropriations Act), authorized HUD to implement certain statutory changes to the United States Housing Act of 1937 (1937 Act) made by the 2014 Appropriations Act through notice, followed by notice and comment rulemaking. Notices implementing the changes were published on May 19, 2014, and June 25, 2014. Consistent with statutory direction, this proposed rule commences the rulemaking process to codify in regulation the statutory changes made to the 1937 Act by the 2014 Appropriations Act and to solicit comment on HUD’s implementation of these changes through the published notices. 60 Day Notice of Proposed Information Collection: Inspector Candidate Assessment Questionnaire. To meet the requirements of the Uniform Physical Condition Standards (UPCS), the Physical Condition of Multifamily Properties and the Public Housing Assessment System (PHAS) rules, the Department conducts physical condition inspections of approximately 14,000 multifamily and public housing properties annually. To conduct these inspections, HUD uses contract inspectors that are trained and certified in the Uniform Physical Condition Standards protocol by HUD. Individuals who wish to be trained and certified by HUD are requested to electronically submit the questionnaire via the Internet. The questionnaire provides HUD with basic knowledge of an individual’s inspection skills and abilities. The HUD form 52768 (ROSS SERVICE COORDINATORS—FUNDING REQUEST) has been revised to add clarifying questions regarding two application types: Resident associations and nonprofit organizations and the form has been somewhat reformatted. Minor formatting changes were made to the HUD form 52769 (ROSS SERVICE COORDINATORS—NEEDS and SERVICE PARTNERS). The FSS Funding Request form (Form 52651) was removed from the collection. The OMB approval number for this collection is pending. The information provided by the eligible applicants will be reviewed and evaluated by HUD. The information to be collected by HUD will be used to preliminarily rate applications, to determine eligibility for the Reentry Assistance Program Grant Competition and to establish grant amounts. Waivers and Alternative Requirements for the Family Self-Sufficiency.  Previously HUD administered the FSS program as two separate programs—one for Housing Choice Voucher (Section 8) participants and one for Public Housing participants. Consolidated Appropriations Act, 2014 provided, however, that the two programs be merged into one program under a separate line item. The objective of the FSS program is to enable participating low-income families to increase their earned income and reduce their dependency on welfare assistance and rental subsidies. Under the FSS program, low-income families are provided opportunities for education, job training, and other forms of social service assistance, while living in assisted housing, so they can obtain skills necessary to achieve self-sufficiency.  The document concerning this information can be found here.

A Capital Needs Assessment is a detailed review of a property’s emergent and expected capital expenses over future years, a span of time known as the ‘‘estimate period.’’ It is needed in order to appropriately value a property to determine if the property is financially sustainable and to plan funding of an escrow account for payment of capital repair and replacement needs during the estimate period. Public Housing Program: Demolition or Disposition of Public Housing Projects, and Conversion of Public Housing to Tenant-Based Assistance; Correction.  On October 16, 2014, HUD published a proposed rule entitled, ‘‘Public Housing Program: Demolition or Disposition of Public Housing Projects, and Conversion of Public Housing to Tenant-Based Assistance’’ (79 FR62250). In § 970.15(a), the proposed rule inadvertently defined the term ‘‘HCC’’as Housing Conservation Coordinators. In § 970.5, ‘‘HCC’’ is correctly defined as Housing Construction Cost. PIH 2014-25 (HA) Over Subsidization in the Housing Choice Voucher Program - On September 28, 2007, the Office of Inspector General (OIG) issued a report on over subsidization in the Housing Choice Voucher (HCV) program due to the issuance of vouchers with unit sizes greater than the number of family members in the household.  Pursuant to the recommendation of the OIG, the Department issued clarifying guidance on the matter of categorization of live-in aides, other reasonable accommodation issues and corresponding data entry into the Inventory Management System (IMS)/Public and Indian Housing Information Center (PIC) through the notices cited above. Notice PIH 2010-51 extended and revised Notice PIH 2009-22 to explain subsidy standards in regard to live-in aides and their PHA-approved family member/s and data entry in IMS/PIC for family members of live-in aides.

Section 184 Indian Housing Loan Guarantee Program New Annual Premium: To meet projected demand for participation in the Section 184 program for fiscal year 2015, HUD is establishing an annual premium of 0.15 percent of the remaining loan balance until the unpaid principal balance, excluding the upfront loan guarantee fee, reaches 78 percent of the lower of the initial sales price or appraised value based on the initial amortization schedule on all new loans, including refinances. With the establishment of the annual premium, the Section 184 program will now have two sources of funds derived from the borrower (the other being the one-time, up-front loan guarantee fee). Without an annual premium, an appropriation of $8 million for Fiscal Year (FY) 2015 2 would support only about $318 million in new loan guarantee commitments, less than half of the amount the program guaranteed in 2013.  Effective date: November 15, 2014

Section 184 Indian Housing Loan Guarantee Program Increase in the Loan Guarantee FeeThe Section 184 Indian Housing Loan Guarantee program (Section 184 program) provides access to sources of private financing for Indian families, Indian housing authorities, and Indian tribes that otherwise could not acquire housing financing because of the unique legal status of Indian land, by guaranteeing loans to eligible persons and entities. Over the last 5 years, the Section 184 program has doubled the number of loans and eligible families being assisted by the program. For HUD to continue to meet the increasing demand for participation in this program, HUD is exercising its new authority to increase the loan guarantee fee to 1.5 percent of the principal obligation from the current rate of 1 percent.

Conforming Amendment to the Section 184 Indian Housing Loan Guarantee Program Regulations: This final rule revises the regulations governing the Section 184 Indian Housing Loan Guarantee program (Section 184 program) to conform to a recent statutory change. The 2013 Consolidated and Further Continuing Appropriations Act amends section 184(d) of the Housing and Community Development Act of 1992 by authorizing HUD to increase the fee for the guarantee of Section 184 loans up to 3 percent of the principal obligation of the loan and to establish the amount of the fee by publishing a notice in the Federal Register. This final rule amends the Section 184 Indian Housing Loan Guarantee Program regulations to reflect this new authority.

This Project-Based Voucher (PBV) Waiver Letter provides an overview of PHA considerations when implementing a PBV program.  This letter discusses some key compliance considerations when implementing a PBV program and how PIH will respond to noncompliance issues.  In summary, retroactive waivers will not be granted when PHAs fail to comply with the regulatory requirements.  Instead, PIH will treat noncompliance with the program requirements as an enforcement issue.

Guidance on NED Recoding- Section 5.b. of PIH Notice 2013-18 (Revised Policies and Procedures for Special Purpose Housing Choice Vouchers for Non-Elderly Disabled Families and Other Populations) provides that a family that meets the definition of a NED family could be coded as such on the 50058 in order for the PHA to reach its baseline of required NED families.  However, once the baseline is established, the PHA must not recode existing participant families as NED when there is turnover.  That same section also states that in regard to monitoring leasing through PIC, it will ensure that upon turnover, NED vouchers are issued to other NED families.  Issuance can only be accomplished through selection from the PHA’s waiting list.
