Prohibition on Exceeding Statutory Limitation of the Number of Public Housing Units - The purpose of this Notice is to advise Public Housing Agencies (PHAs) and HUD Field Offices of the Department’s decision that all PHAs, including Moving to Work PHAs, are prohibited from adding public housing units that exceedthe statutory limit.  This restriction applies to the construction, as well as the use of acquisition and acquisition with rehabilitation development methods, of all public housing units in excess of the Faircloth limit, regardless of the source of funds.

Extension of Notice 2010-49: Protecting Tenants at Foreclosure Act – Guidance on New Tenant Protections - This Notice reinstates Notice PIH 2010-49, which will expire on December 31, 2011.  Procedures contained within PIH Notice 2010-49 remain in effect until the statutory provisions sunset on December 31, 2014.

Timely Reporting Requirements of the Family Report (form HUD-50058 and form HUD- 50058 MTW) into the Public and Indian Housing Information Center - The purpose of this notice is to extend Notice PIH 2010-25 (with a significant revision to section 4.A. and minor changes to section 4.B.) which established timeframes for timely reporting of the Family Report (form HUD-50058) into the Public and Indian Housing Information Center (PIC), explained PIC modifications and clarified Family Self-Sufficiency (FSS) reporting requirements. Dun and Bradstreet Universal Numbering System (DUNS) Requirement - This Notice reminds tribes and tribally designated housing entities (TDHE) applying for Indian Housing Block Grant (IHBG) or Indian Community Development Block Grant (ICDBG) funds that they must obtain a Dun and Bradstreet Numbering System (DUNS) number and register with the Central Contractor Registration (CCR) prior to receiving IHBG or ICDBG funds.  In addition, once a DUNS number is obtained, the CCR registration must be updated annually.

Instructions for Public Housing Agency on Fiscal Year End Changes - This notice provides instructions to public housing agencies (PHAs) on submitting requests for fiscal year end (FYE) changes.  The process ensures that HUD has information for approval or denial and provides sufficient lead time for HUD to update required databases.

Emergency Safety and Security Funding as it Relates to the Department of Defense and Full-Year Continuing Appropriations Act, 2011 [Public Law 112-10] - This Notice provides guidance to public housing agencies (PHAs) seeking Emergency Capital Needs funding for safety and security measures utilizing FY 2011 funds.  This Notice provides instructions regarding the application and funding process for emergency safety and security funding only.  This Notice does not apply to funding for unforeseen or unpreventable emergencies or for non-presidentially declared natural disasters.

Public Housing Operating Subsidy Calculations for Calendar Year 2012 - This notice provides public housing agencies (PHAs) with instructions for operating subsidy calculation submissions in Calendar Year (CY) 2012 as funded from Federal Fiscal Year (FFY) 2012 appropriations.  It also informs PHAs that in an effort to reduce their reporting burdens HUD will use information in its systems of record to determine operating subsidy eligibility.  HUD is committed to providing eligibility information to PHAs prior to the start of CY2012. Guidance on the Project-Based Voucher Program - The purpose of this notice is to clarify certain issues related to the project-based voucher (PBV) program.  HUD intends to issue a more in-depth guidebook related to this program.  However, this notice is intended to address specific concerns that have come to the attention of the Department recently.  Please note that this notice is not inclusive of all requirements related to the PBV program.

Extension- Administrative Requirements for Investing Indian Housing Block Grant (IHBG) Funds - This Notice extends Notice PIH 2010-33 (TDHE), same subject, which expires August 31, 2011. The purpose of this Notice is to establish the basis upon which the Department will determine if a recipient of Indian Housing Block Grant (IHBG) funds, as authorized by the Native American Housing Assistance and Self-Determination Act (NAHASDA) of 1996 (Pub. L. 104-330, as amended), has the administrative capacity to draw down IHBG funds for investment purposes.

Depository Agreements for Recipients of the Indian Housing Block Grant (IHBG) Program - The purpose of this Notice is to extend Notice PIH 2010-31 which transmitted the current depository agreement forms to be used when investing IHBG funds; form HUD-52736-A (10/2004) for banking accounts and form HUD-52736-B (10/2004) for brokers/dealers. Also, the Notice clarifies when to use depository forms and when tribes or tribally designated housing entities (TDHEs) may utilize brokers in the investment of Indian Housing Block Grant (IHBG) funds under 24 CFR 1000.58.

Extension: Information and Procedures for Implementation of Capital Funds Recovery Competition Grants - This notice extends notice PIH-2010-34 (HA) without change. This notice provides Public Housing Agencies (PHAs) and HUD Field Offices with processing information regarding the implementation of Capital Funds Recovery Competition (CFRC) grants as authorized by the American Recovery and Reinvestment Act of 2009 (“Recovery Act”).  This notice applies to PHAs awarded a competition grant in one of the five categories established under the revised Notice of Funding Availability (NOFA) published on June 3, 2009.

Extension: Consolidated Guidance on Disaster Housing Assistance Program - Ike (DHAP-Ike) and Extension Operating Requirements - The DHAP-Ike is a FEMA-HUD initiative administered by HUD’s network of public housing agencies (PHAs) to provide monthly rental assistance, case management services, security and utility deposit assistance for certain families displaced from their homes by Hurricanes Gustav or Ike. PIH 2011-34 (HA) Issued: June 28, 2011

Extension - Continuation of Disaster Voucher Program (DVP) Housing Assistance Payments - This notice extends for another year Notice PIH 2010-43, same subject, which is set to expire October 31, 2011. This notice does not supersede the previous guidance. Instead, it updates specific sections in the previous guidance with the new end date and informs public housing authorities (PHAs) administering DVP to continue to provide monthly housing assistance payment for current DVP families past June 30, 2011. Previous guidance remains in effect except where noted. The Department has projected that there is sufficient DVP funding remaining to continue providing monthly HAP on behalf of current DVP families through December 31, 2011.

Use of Work Preferences as a Public Housing Waiting List Management Tool and as a Lease Provision for Certain Public Housing Buildings -  This notice clarifies program policy related to establishing local preferences, the use of work preferences as a public housing waiting list management tool, and the inclusion of work activities in house rules and as a lease provision for certain public housing buildings. The purpose of this notice is to ensure that eligible households have full and equal access to the public housing program and that local preferences are implemented in a manner that is consistent with statutory and regulatory requirements.

Guidance on non-discrimination and equal opportunity requirements for PHAs - The purpose of this notice is to remind public housing agencies (PHAs), including those in the Moving to Work (MTW) demonstration, of their obligation to comply with key non-discrimination and equal opportunity laws and implementing regulations, including those in 24 CFR § 5.105(a).  Specific laws and regulations must be viewed in their entirety for full compliance, as the notice does not incorporate a complete discussion of all legal authorities. PHA Mortgaged Projects:  Procedures for Section 30 Mortgage Transactions - The purpose of this notice is to provide guidance to public housing authorities (PHAs) on how to pursue HUD approval to place a mortgage or other encumbrance on public housing property where the subject property is owned by the PHA, defined as PHA mortgaged transactions (PMT).

HQS Inspections for the Housing Choice Voucher Program and Guidance Related to Electrical Outlets - This Notice reviews the existing Housing Quality Standards (HQS) requirements and clarifies the existing guidance that Public Housing Agencies (PHAs) may rely upon when conducting inspections. 
It also offers additional guidance on what types of three-prong electrical outlets an inspector
should consider acceptable under HQS.

Cost- Savings Measures in the Housing Choice Voucher (HCV) Program - This notice extends and revises Notice PIH 2009-44 which provided:  (1) guidance on actions public housing agencies (PHA) may take to address financial shortfalls by reducing costs in the HCV program; and (2) information on the circumstances under which a PHA may deny a move under 24 CFR § 982.314(e)(1) or terminate a housing assistance payments (HAP) contract under 24 CFR §982.454 as a result of insufficient funding.  The revisions to Notice PIH 2009-44 are bolded.

Implementation of the Federal Fiscal Year 2011 Funding Provisions for the Housing Choice Voucher Program - This Notice implements the Housing Choice Voucher (HCV) program funding provisions of  H.R. 1473 Department of Defense and Full-Year Continuing Appropriations Act, 2011 (PL 112-10) referred to hereafter as “the 2011 Act,” enacted on April 15, 2011. The 2011 Act establishes the allocation methodology for calculating housing assistance payments (HAP) renewal funds, new incremental vouchers and administrative fees.
PIH 2011-26 (TDHE) Issued: May 25, 2011 Extension—Establishing a Micro Purchase Process for Purchases Less Than $5,000 for Indian Housing Block Grant (IHBG) Recipients - The purpose of this Notice is to reduce the burden of complying with the federal procurement process for goods and services of minimal cost.  Specifically, Micro Purchasing allows a grantee to purchase goods and services costing less than $5,000 without obtaining and documenting price quotes.

Indian Housing Plan/Annual Performance Report Form – Form HUD-52737 - The purpose of this Notice is to inform tribes and tribally designated housing entities (TDHE) of the new combined Indian Housing Plan/Annual Performance Report (IHP/APR) form that will replace the individual IHP (HUD-52735) and APR (HUD-52735-AS) forms beginning in Federal Fiscal Year (FFY) 2012 for the Indian Housing Block Grant (IHBG) program.  Grants funded under the American Recovery and Reinvestment Act of 2009 (ARRA) are excluded from this Notice (see page 6, paragraph 16).
