12/01/09 Funds Authorizations for use of Reserve for Replacement or Residual Receipts, HUD Form 9250 was revised January 2008. Please use this current form. Previous editions are obsolete.
11/30/09 Inspector Notice No: 2009-03 Inspecting Elevator Equipment Rooms, established specific requirements that HUD assisted and insured properties with elevators must meet so that Uniform Physical Inspection Condition Standards (UPCS) inspections will be conducted as and when scheduled. These requirements become effective on January 4, 2010.

11/12/09 New Due Dates and Technical Corrections to the Section 202 and Section 811 NOFAs. The Section 202 and Section 811 deadline dates for FY2009 have been extended. Applications for Section 202 are due on December 14th. Section 811 applications are now due on December 17th.
Technical corrections to the NOFAs and related Questions and Answers for Section 202 and Section 811. Applicants who submitted their applications prior to this publication can choose to resubmit an updated application that reflects the corrections and clarifications. The last application received by Grants.gov by the December 14, 2009 or December 17, 2009 deadline, as appropriate, and in accordance with HUD's FY2009 Grace Period Policy will be the application that is reviewed and rated. Also, the Phase II Environmental Assessment is being moved to January 14, 2010 (202) and January 19, 2010 (811).something

Implementation date for the new Chapter 6 of HUD Handbook 4350.1, REV-1 has been extended. The September 29, 2009, date is no longer valid. The new proposed implementation date will be after January 1, 2010. FAQ's should be coming soon.

  HUD Notice 09-16 October 2nd, 2009 - Temporary employment payments received from the U.S. Census Bureau excluded from annual income calculations used in determining housing assistance payments.
10/01/09 HUD Notice 09-15 October 1st, 2009 - Provides guidance to owners and management agents (O/As) on the implementation of the Violence Against Women Act (VAWA). VAWA provides legal protections to victims of domestic violence, dating violence or stalking which prohibit owner/agents from evicting or terminating assistance from individuals covered under VAWA.

Housing Notice 2009-13, dated September 15, 2009 Applications for Housing Assistance - Supplemental Information (Tenant Advocates) Guidance for owners and management agents (O/As) and Public Housing Agencies (PHAs) regarding a tenant's right to provide a contact to advocate for special care or services, or to help resolve any issues that arise while living in HUD-assisted housing. This Notice also includes the mandatory HUD-92006, Supplement to Application for Federally Assisted Housing, (Attachment A) which must accompany the O/A or PHA application

Reminder: The Refinement of Income and Rent Determination Requirements in Public and Assisted Housing Final Rule CANNOT be implemented prior to the current effective date of September 30, 2009. Also, existing tenants and applicants should start the process of applying for a Social Security Number (SSN) if they do not already have one. The majority of current tenants without SSNs are under the age of six.

06/17/09 New Real Estate Assessment Center (REAC) Financial Assessment Sub System (FASS) Verification Screen. The Verification screen in FASSUB (Financial Assessment Subsystem - Submission) requires submitters to verify certain critical information from HUD's IREMS database. Check accuracy and correct any errors before a draft submission template is created. If financial statements are submitted with inaccurate reporting periods or other incorrect information, we must archive them and the owner must resubmit. If there are errors in ownership information, the owner must correct these errors in the Active Partners Performance System (APPS). Instructions if there are errors in the reporting period, contact your local project manager

Translations of HUD Model Leases and Sample Documents
HUD model lease forms at now expire 5/31/2011. The leases have been translated into Arabic, Armenian, Chinese (Traditional), Farsi, French (Canadian), Khmer (Cambodian), Korean, Portuguese (Brazil), Russian, Spanish, Tagalog, and Vietnamese. Currently the lease translations are all in one zip file.  These links will be converted to a dropdown so that users can more easily access the lease documents.

Currently the lease translations are contained in a zip file from which the user can choose the appropriate translation. The link will soon be converted to a dropdown so that users who do not have the ability to use the zip directory can more easily access the lease documents.

06/09/09 HUD is finalizing negotiations with the Department of Health and Human Services (HHS) for retention of the National Directory of New Hires (NDNH) employment and income data obtained from the Enterprise Income Verification (EIV) system.
  HHS will retain the EIV printed reports for the term of tenancy plus three years. With this change, owners and management agents (O/As) will no longer need to destroy the EIV printed reports containing NDNH data in the tenant files when the reports are two years old. This change will be incorporated in a revision to Notice H2008-3.

  Section 8 Renewal Policy guide book revision. This primarily clarifies language in Chapter 4 regarding Section 8 renewals where owners have selected Option 2, Renewals at or Below Market Rents. In addition to several small changes and clarifications, the revision also details a provision for increased owner distributions as a preservation incentive for current limited distribution owners. Please read through the guidance and make sure to incorporate the new changes to the Section 8 Renewal Guide.

News from REAC - No filing extension
There will be no filing extension for properties with 12/31/08 fiscal year end date.
  The Financial Assessment Subsystem (FASSUB) was temporarily down between the morning of March 11, 2009, and the afternoon of March 13, 2009. During that time Multifamily Housing owners were unable to file Annual Financial Statements. The Department has received requests to extend the April 1st AFS filing due date for property owners with a 12/31 fiscal year end date. Based on the short period of time the system was unavailable, an extension of the time period to file financial reports will not be provided.
03/16/09 The following changes in Special Claims processing and Section 236 Excess Income reporting are effective Monday, March 16, 2009: Special Claims for HUD-ADMINISTERED PROPERTIES: What's a "HUD-administered property"? A property that works directly with HUD (not through a Contract Administrator, such as Contract Management Services in Washington, or Oregon Housing & Community Services) in the administration of its subsidy contract. An example of a HUD-administered property would be a Section 202 or 811 property with a Project Rental Assistance Contract (PRAC). Effective March 16, 2009, Special Claims for HUD-administered properties will be submitted directly to the assigned HUD Project Manager. Even though every property has a HUD Project Manager, this only applies toHUD-administered properties (see above). For more information on Special Claims, see HUD's Special Claims Processing Guide and Chapter 9-14 of HUD Handbook 4350.3

Section 236 Excess Income Reports have updated points-of-contact, although the submission address remains the same.

Check out the updated form HUD 9250, Reserve Fund for Replacement Authorizations, (HUDClips What's New 1/22/09) New language has been added to the form to encourage use of energy efficient products.  The revised form requires:

A list of appliances and/or major components that will be replaced along with a notation of whether or not the replacement items will be energy efficient products.  If replacement items are not energy efficient products, the owner/agent must provide a justification.

01/09/09 Disaster Reminder: Flood Insurance required in special flood hazard areas. The recent flooding in Washington and Oregon is a sharp reminder that the requirement for flood insurance for properties located in a special flood hazard area is not only a standard requirement for insured projects per the Regulatory Agreement, but also in most Housing Assistance Payments (HAP) Contracts: "Flood Insurance. If the project is in a special flood hazard area, the Owner agrees that the project will be covered, curing its anticipated economic or useful life, by flood insurance in an amount equal to its development or project cost (less estimated land cost) or to the maximum limit of coverage made available with respect to the particular type of property under the National Flood Insurance Act of 1968, whichever is less."

01/08/09 Enterprise Income Verification (EIV) System training class from December 16-17, 2008 now available on archived webcast Materials and agenda HUD staff deliver an informative slide presentation ranging from gaining and continuing EIV access, reading income information and verification reports, resolving tenant income discrepancies (including case studies) to monitoring O/A activities, as the Department moves toward eventually mandating the use of EIV for multifamily housing programs.
01/02/09 The General Section of HUD's FY2009 NOFA (Notice of Funding Availability) has been published. In 2009, HUD plans to publish its NOFAs as they are approved for publication and not in a combined SuperNOFA. The anticipated schedule for release for the Section 202 Supportive Housing for the Elderly and Section 811 Supportive Housing for Persons with Disabilities NOFAs, subject to availability of appropriations, is currently projected for February through April 2009. Newest information Applicants are urged to sign up for Grants.gov's information subscription service. New users to Grants.gov will be required to complete a five-step registration process, which can take 2 to 4 weeks. If there is a discrepancy in the information, the registration cannot be completed until issues are resolved. Applicants that have previously completed the registration process have to renew or update their registration in the Central Contractor Registration (CCR). The renewal/update process confirms that the registration information is still accurate and allows organizations to make any appropriate changes. Please allow adequate time to resolve any registration issues.
