05/09/12 Basic Environmental Review Training HUD Region 8's 2012 edition of the annual, comprehensive, environmental review training course with be offered from June 20-22, 2012 live in Denver. Also via video-conference to the five HUD Region 8 Field Offices.
01/27/12 Housing Choice Voucher (HCV) - Homeownership Option 10 Year Asset Exclusion: On January 27, 2012 HUD published Notice PIH 2012-2 (HA). The notice provides guidance on including the value of a home in net family assets starting in the eleventh year of homeownership under the HCV program.
01/27/12 Family Unification Program (FUP) Survey: On January 27, 2012, HUD published an information collection notice in the Federal Register regarding its intent to conduct a survey for research on the role of FUP vouchers in providing housing for youth aging out of foster care. The comment due date is March 27, 2012.
01/25/12 Study of PHA Engagement with Homeless Households: On January 25, 2012, HUD published a Federal Register notice regarding a study to explore and document how PHAs currently serve and interact with homeless households. The comment due date is February 24, 2012.
01/25/12 Family Unification Program (FUP) Application Forms: On January 25, 2012, HUD published an information collection notice in the Federal Register regarding FUP application forms to be used as part of the HUD SuperNOFA process. The comment due date is February 24, 2012.
01/20/12 2012-2 Guidance on Public Housing Operating Funds: On January 20, 2012, HUD published PIH Notice 2012-1 (HA). This Notice describes eligible uses of operating subsidy for PHAs
01/18/12 January 2012 Eco Wise Newsletter: The January 2012 version of HUD's Eco Wise newsletter is now available. This issue focuses on water conservation and innovative irrigation and landscaping.
01/06/12 Income Exclusion of Kinship, Kin-GAP and Other Guardianship Care Payments: On January 6, 2012, HUD issued Notice PIH-2012-1 (HA). This Notice clarifies the treatment of income received from Kin-GAP, kinship care payments, and other guardianship care payments
01/03/12 2012 Operating Subsidy Explanation: HUD has published on its website an "Explanation of Initial CY 2012 Obligations". This document, along with other related information has been posted to the FMD Calendar year 2012 web page.
12/27/11 Public Housing Units and The Fairclouth Limit: On December 27, 2011 HUD issued Notice PIH 2011-69(HA). This notice addresses the development of new public housing units and statutory confines pursuant to Fairclouth requirements.
12/23/11 HCV Program - Administrative Fee Study: On December 23, 2011 HUD published a Federal Register notice regarding additional survey and data collection activity in association with an administrative fee study to help develop a new administrative fee allocation formula. The comment due date is January 23, 2011.
12/19/11 Regulatory Waivers Granted for the Third Quarter of Calendar Year 2011: On December 19, 2011 HUD published a Federal Register notice identifying waivers granted during the third quarter of 2011.
12/16/11 Protecting Tenants at Foreclosure Act: On December 16, 2011 HUD issued Notice PIH 2011-68(HA). This notice reinstates PIH Notice 2010-49 which addresses protections for HCV participants living in units impacted by foreclosure actions.
  Resident Opportunities and Self-Sufficiency (ROSS) Program Forms: On December 16, 2011 HUD published a Federal Register notice regarding proposed changes to some ROSS forms. The comment due date is February 14, 2012.
  New Forms for Project-Based Voucher (PBV) Program: On December 16, 2011 HUD published a Federal Register notice regarding its intent to issue new forms for the PBV programs. This would include forms for: (1) A notice from a PHA to the HUD field office regarding its intent to project-base any of its tenant-based vouchers; (2) a request from PBV project owner to the HUD field office for approval to terminate a PBV HAP contract if the owner's rent is adjusted below the initial rent; and (3) the owner's 12-month notice to tenants regarding owner's intent to terminate PBV HAP contract. The comment due date is February 14, 2012.
12/09/11 Cash Management Requirements for the HCV Program: On December 9, 2011 HUD issued Notice PIH 2011-67(HA). This notice addresses new cash management requirements and procedures for the disbursement of HAP funds to PHAs.
12/06/11 HUD-GreatSchools Partnership: On December 6, 2011 Assistant Secretary Sandra Henriquez announced HUD's partnership with GreatSchools, a national non-profit educational resource for parents. The purpose of this partnership is to give parents living in public housing or who receive HCV rental assistance greater access to local school information that will help them make more informed decisions about where to send their children to school.
12/02/11 PHA Family Reporting Requirements On November 30, HUD issued PIH notice 2011-65, which extends Notice PIH 2010-25, with a significant revision to section 4.A. and minor changes to section 4.B., which established timeframes for timely reporting of the Family Report (form HUD-50058) into the Public and Indian Housing Information Center (PIC), explained PIC modifications and clarified Family Self- Sufficiency (FSS) reporting requirements. Section 4.A. has been revised to only require reporting of issuance of voucher (action code 10) for new admissions and portability move-ins.
11/29/11 Public and Indian Housing One-Stop Tool (POST): HUD is announcing the launch of the Public and Indian Housing One-Stop Tool (POST) for PHAs, as part of HUD's Delivering Together initiative. POST for PHAs is a one-stop website that enables PHAs to quickly access PIH systems, tools, program requirements, and much more. The POST homepage organizes information into eight categories PHAs have indicated make the most sense to them: (1) Public Housing Program; (2) Housing Choice Voucher Program; (3) Grants; (4) Other Programs; (5) Systems; (6) Tools; (7); Laws and Policies; and (8) Directories. Another exciting feature of POST for PHAs is the PIH A-Z Index, an exhaustive alphabetical list of information relevant to PHA programs. Additionally, HUD has several new features under development that will make useful web content even more accessible, including a Calendar of Due Dates for PHAs, an email box for PHAs to suggest improvements to POST, and a list of PIH Forms. Rather than spend considerable time searching for information and resources, PHAs will be able to access all the material they need on POST for PHAs.
11/25/11 Public Housing Energy Audits: On November 17, 2011, HUD published in the Federal Register a proposed rule on energy audit requirements. In addition to clarifying energy audit requirements applicable to HUD's public housing program, the proposed rule identifies energy-efficient measures PHAs must address in their energy audit. The proposed rule also moves the energy audit requirements to a different part of HUD's title of the Code of Federal Regulations. The comment due date is January 17, 2012.
  Study of Public Housing Agencies' Engagement with Homeless Households: On November 14, 2011, HUD published a notice in the Federal Register regarding its intent to collect data on how PHAs currently serve and interact with homeless households. The comment due date is January 13, 2012.
  Evaluation of the Veterans Homelessness Prevention Demonstration: On November 14, 2011, HUD published a Federal Register notice regarding its intent to collect information to evaluate the Veterans Homelessness Prevention Demonstration. The comment due date is January 13, 2012.
  Extension of Cost-Test and Market Analyses Guidelines for the Voluntary Conversion of Public Housing Units: On November 2, 2011 HUD issued PIH Notice 2011-62(HA). This notice extends indefinitely PIH Notices 2009-42 and 2010-48 regarding the voluntary conversion of public housing units to tenant-based assistance.
  Declaration of trust (DOT) Recording Requirements: On November 1, 2011, HUD issued PIH Notice 2011-61 (HA). This notice extends indefinitely PIH Notice 2009 -28 (HA) which addresses DOT requirements for PHAs.
  Reporting of Administrative Fee Reserves: On October 27, 2011 HUD Issued PIH Notice 2011-59. This notice reissues, with a few minor additions, PIH Notice 2011-7 (HA) which provides guidance on the use of administrative fee reserves and reiterates guidance on PHA cash management and approved investment instruments. The new notice also provides guidance on the reporting of administrative fee reserves.
  Operating Cost Adjustment Factors (OCAF) for 2012: On October 26, 2011, HUD published the 2012 OCAF in the Federal Register. OCAFs are annual factors used to adjust Section 8 rents under several of HUD's funded programs.
  Family Unification Program (FUP): On October 26, 2011, HUD published in the Federal Register an information collection notice regarding the FUP program. The comment due date is December 27, 2011.
  PIC Reporting Requirements for Capital Fund Formula Allocation: On October 24, 2011, HUD issued PIH Notice 2011-58 (HA). This notice addresses PHA requirement to certify to the accuracy of data submitted to HUD in the Inventory Management System/PIC. HUD uses this data to calculate the formula for allocating Capital und grants.
11/23/11 Toolkit for Carbon Monoxide Poisoning Prevention: The Center for Disease Control and Prevention has a new toolkit for carbon monoxide prevention. The toolkit features downloadable and easy to use resources that housing agencies can include in their own education and outreach activities. You can download these mater8als free of charge.
11/03/11 DUNS & CCR Registration Requirement and Instructions: On October 28, 2011, HUD published PIH Notice 2011-60. This notice requires public housing agencies (PHAs), their affiliates, instrumentalities, contract management and owner entities receiving HUD funding to obtain Dun and Bradstreet Numbering System (DUNS) numbers and to register in the Central Contractor Registration (CCR) within 60 days. Instructions can be found within the notice.
  Requirement for Declarations of Trust: On November 1st, HUD published PIH Notice 2011-61. This notice includes guidance on requirement for PHAs to record current Declaration of Trusts (DOTs) against all public housing property and guidance on adding and removing public housing units and other property from the Annual Contributions Contract (ACC).
10/05/11 2012 Fair Market Rents (FMR): HUD published the final 2012 FMR calculations in Federal Register on September 30th, along with a summary of public comments and responses, which can be found here. No significant changes have been made in Region VIII from the proposed FMRs.
  2012 Capital Fund Certification: HUD has opened the 2012 Capital Fund Certification period for Public Housing Authorities (PHA.) PHAs are to certify their Public and Indian Housing (PIH) Information Center (PIC) / PIH Inventory Management System (PIC/IMS) data in accordance with PIH Notice 2010-42 for purposes of calculating the Capital Fund formula for 2012 by November 4, 2011. Please see this website for step-by-step instruction.
09/27/11 Proposed SEMAP Measurement and Verification Change: On September 23rd, HUD published a proposed rule in the Federal Register that would change the way HUD measures and verifies performance under the Section Eight Management Assessment Program (SEMAP) lease-up indicator. Comments are due to HUD by October 24th, 2011.
09/02/11 PHA Executive Compensation and Salary Comparability Reporting Guidance PIH Notice 2011-48, which provides information on reporting PHA executive compensation and salary comparability analysis was issued by HUD on 8/26/11. PHAs should review the notice and attached excel file for guidance on reporting requirements.
08/19/11 Proposed 2012 Fair Market Rents On August 19, 2011 HUD published a Federal Register notice with proposed 2012 Fair Market Rents for the Housing Choice Voucher (HCV) and Moderate Rehabilitation Single Room Occupancy programs. Comments are due by September 19, 2011.
07/08/11 2011 NOFA - Capital Fund Education and Training Community Facilities (CFCF) Program: On June 17, 2011 HUD published a Federal Register notice regarding the availability of some $15 Million for the CFCF program. The purpose of the CFCF Program is to provide capital funding to PHAs for the construction, rehabilitation, or purchase of facilities to provide early childhood education, adult education, and/or job training programs for public housing residents.
  Capital Fund Education and Training Community Facilities (CFCF) Program Application Requirements: Be sure to check out HUD's web page for application requirements for the CFCF program. The application due date is July 21, 2011.
  2011 NOFA - HOPE VI Main Street Grants: On June 30, 2011 HUD published a Federal Register notice regarding the availability of approximately $500,000 for HOPE VI Main Street grants. The purpose of this program is to provide grants to small communities to assist in the rejuvenation of an historic or traditional central business district ("Main Street") area by replacing unused commercial space in buildings with affordable housing units.
  HOPE VI Main Street Application Requirements: Be sure to check out HUD's web page for application requirements for the HOPE VI Main Street program. The application due date is August 22, 2011.
  VASH Program ListServ: HUD has started a HUD-VASH listserv that HUD and VA headquarters staff will use to communicate information on the program. Messages posted to the listserv may include the following information/topics:
  • Notices, rules, Q &As, program guidance, etc.
  • Program achievements and progress (only national totals, not the numbers of specific sites)
  • Success stories/best practices (if focused on a specific veteran, would receive permission to post)
  • General information related to ending veterans homelessness
PHAs are encouraged to sign up.
  Tenant Resource Network Program: On July 6, 2011 HUD published a Federal Register notice regarding a proposed Tenant Resource Network (TRN) Program. The purpose of TRN is to make grants to organizations to assist, inform and educate tenants of Section 8-assisted properties regarding their rights, responsibilities and options when an assisted property opts out of an affordable housing program or is poorly maintained. Comments are due by August 5, 2011.
  Public Housing Financial Management Template: On July 6, 2011 HUD published an information collection notice in the Federal Register regarding its intent to extend the electronic submission reporting requirements for the Public Housing Financial Management Template under the Public Housing Assessment System. The comment due date is August 5, 2011.
  Disaster Housing Assistance Program (DHAP) Study: On July 6, 2011 HUD published a Federal Register notice regarding its intent to undertake a DHAP Incremental Rent Transition Study. This would be a study of DHAP families who transitioned from stepped-up rents to market rate or assisted housing and track their housing, employment and financial outcomes over time. The comment due date is August 5, 2011.
07/06/11 2011 Operating Fund Obligation Letters: Headquarters has posted PHA letters for 2011 operating fund obligations through September 30, 2011.
  Evidence Matters: HUD's Office of Policy Development and Research has published the Spring 2011 issue of Evidence Matters. There are articles on rental housing policy you will find interesting.
  DHAP - Ike Program: On June 30, 2011, HUD issued Notice PIH 2011-35(HA). This notice extends the program until September 30, 2011.
06/30/11 2011 Operating Subsidy Guidance: Please be sure to frequently check out HUD's web page for guidance on the 2011 Operating Fund process and documents. New items can be found in the Excel Tools and Data Collection and the Notes and Guidance sections of the web page.
  Special Purpose Housing Choice Vouchers: On June 14, 2011 HUD issued Notice PIH 2011-32. This notice establishes policies and procedures for issuing, tracking and monitoring Housing Choice Vouchers (HCV) that were awarded under a NOFA to provide rental assistance specifically for non-elderly disabled (NED) families. These policies and procedures address initial issuance, re-issuance and maintenance of NED HCVs, tracking them in PIC and issues related to reasonable accommodation. The notice also addresses FUP and VASH vouchers when a PHA is facing a funding shortfall.
  Guidance on Non-discrimination and Equal Opportunity Requirements for PHAs: On June 13, 2011 HUD issued Notice PIH 2011-31. The purpose of this notice is to remind all PHAs of their obligation to comply with key non-discrimination and equal opportunity laws and implementing regulations. This notice should be read in conjunction with PIH Notice 2010-26 as well as the legal authorities cited.
  PHA Mortgaged Transactions: On June 8, 2011 HUD issued Notice PIH 2011-30. This notice provides guidance to PHAs on how to pursue HUD approval to place a mortgage or other encumbrance on public housing property.
  HQS Inspections and Guidance Related to Electrical Outlets: On June 3, 2011 HUD issued Notice PIH 2011-29. This notice provides HQS guidance, including guidance on three-prong outlets.
  Cost Savings Measures in the Housing Choice Voucher (HCV) Program: On May 27, 2011 HUD issued Notice PIH 2011-28. This notice extends and revises Notice PIH 2009-44 which provided (1) guidance on actions PHAs may take to address financial shortfalls by reducing costs in the HCV program; and (2) information on the circumstances under which a PHA may deny a move request or terminate a HAP contract as a result of insufficient funding.
  FY 2011 Funding for the HCV Program: On June 2, 2011 HUD issued Notice PIH 2011-27. This notice addresses the 2011 funding process for the HCV program.
04/19/11 April Asset Management Newsletter Now Available: This month's Asset Management Newsletter is available online on the HUD website. It features guidance on recent HUD notices and a review of selected mixed financing policies.
  Guidance on Asset Repositioning Fees and Re-occupying Units Proposed or Approved for Demolition, Disposition, or Homeownership: Notice PIH 2011-18(HA) was issued on April 12 and provides guidance on the implementation of the asset-repositioning fee (ARF) pursuant to 24 CFR § 990.190(h) and on re-occupying public housing units proposed or approved for demolition, disposition, or transition to homeownership.
  EIV Training: HUD's Office of Public and Indian Housing (PIH) is planning to offer Updated Enterprise Income Verification (EIV) System 9.2 training in Washington, DC and via webcast for all PIH EIV system users on Monday, May 2, 2011; 1PM - 5PM EDT. Please click here to access the webcast, and training materials can be found here on the morning of the webcast. Registration is not required, and all EIV uses must complete this training by October 30, 2011.
  HUD Press Release: March Issue of Cityscape Sheds New Light on Homelessness: HUD has published its March issue of a quarterly magazine examining homelessness in America.
  New Study: Evaluation of the Family Self Sufficiency Program: HUD has released a study of FSS participants and programs, showing positive results for those who complete program requirements.
  2011 Public Housing Operating Subsidy Calculations: Notice PIH 2011-16(HA) was issued on March 18, 2011. This notice provides guidance to housing authorities on how to calculate operating subsidy submissions for 2011.
03/31/11 March Ecowise Newsletter Released: The March edition of the Ecowise newsletter is available online and features helpful tips on topics such as the upcoming Going Green conference in Boston and a sustainability project in Alaska.
  Proposed Information Collection for Public Comment; Public Housing Inventory Removal Application: On March 25th, HUD published a Notice of Proposed Information Collection regarding Public Housing Demolition and Disposition applications. Comments are due May 24, 2011.
  Proposed Information Collection for Public Comment: On March 25th, HUD published a Notice of Proposed Information Collection regarding Public Housing Homeownership Programs ongoing under the former 5(h) authority. Comments are due May 24, 2011.
  Reallocation of Unexpended 2009 ARRA funds: On March 23rd, HUD published a Notice in the Federal Register announcing the Public Housing grantees that received an allocation of the $17,161,649 recaptured ARRA Capital Funds.
  Guidance for Financing Unsecured by Public Housing Assets: Notice PIH 2011-14(HA) was issued on February 24, 2011. This notice provides guidance to housing authorities on how to comply with public housing requirements when undertaking financing that is not secured by public housing assets.
  Guidance on IMS/PIC Development Sub-Module and Reporting: This notice, PIH 2011-07 (HA) provides guidance to ensure that information submitted and maintained by PHAs in the Inventory Management System/PIH Information Center (IMS/PIC) Development Sub-Module is accurate, timely, and reliable.
  February Ecowise Newsletter Released: February's edition of the Ecowise newsletter is available online and features helpful tips on topics such as integrated pest management and upcoming sustainability events.
  March Asset Management Newsletter Released: This month's Asset Management Newsletter is available online on the HUD website. It features guidance on recent HUD notices and a review of selected mixed financing policies.

02/25/11 Public Housing Assessment System (PHAS) - Interim Rule: On February 23, 2011 HUD published a PHAS interim rule in the Federal Register. This interim rule is effective starting March 25, 2011 and the comment due date is April 25, 2011.
  Public Housing Assessment System (PHAS) - Management Operations Scoring Notice: On February 23, 2011 HUD published in the Federal Register the processing notice for issuing scores under the management operations indicator for PHAS. The comment due date is April 25, 2011.
  Public Housing Assessment System (PHAS) - Financial Condition Scoring Notice: On February 23, 2011 HUD published in the Federal Register the processing notice for issuing scores under the financial condition indicator for PHAS. The comment due date is April 25, 2011.
  Public Housing Assessment System (PHAS) - Physical Condition Scoring Notice: On February 23, 2011 HUD published in the Federal Register the processing notice for issuing scores under the physical condition indicator for PHAS. The comment due date is April 25, 2011.
  Public Housing Assessment System (PHAS) - Capital Fund Scoring Notice: On February 23, 2011 HUD published in the Federal Register the processing notice for issuing scores under the capital fund program indicator for PHAS. The comment due date is April 25, 2011.
  Public Housing Assessment System (PHAS) - Appeals, Technical Reviews and Database Adjustments: On February 23, 2011 HUD published an information collection notice in the Federal Register regarding information collected for PHAS appeals, technical reviews and database adjustments. Comments are due by April 25, 2011.
  Public Housing Capital Fund Program (CFP - Proposed Rule: On February 7, 2011 HUD published a proposed CFP rule in the Federal Register. One of the changes proposed for the CFP is to separate the CFP information requirements from the PHA Annual Plan requirements. Comments are due by April 8, 2011.
  "eLogic Model" Grant Performance Report Standard: On February 23, 2011 HUD published an information collection notice in the Federal Register regarding Logic Models. His notice provides reporting guidance for Logic Models, form HUD 96010, which applicants submit when applying for HUD funding.
02/18/11 Community Service and Self-Sufficiency Requirement (CSSR): Notice PIH 2011-11(HA) was issued on February 11, 2011. This notice extends for another year Notice PIH 2009-48 which addresses PHA and tenant CSSR responsibilities.
  Appeals under the Operating Fund Program for Calendar Year 2011: This notice provides instructions for PHA 2011 operating fund appeals. Please note that copies of appeals submitted to Washington, D.C. must also be submitted to the Denver office of Public Housing.
  Guidance for Obtaining HUD Consent for Takings of Public Housing Property by Eminent Domain: Notice PIH 2011-8(HA) was issued on January 28, 2011. This notice extends for another year Notice PIH 2010-04(PHA) which provides guidance on eminent domain activities.
02/17/11 "Evidence Matters" - A New Independent Quarterly Publication: On February 15, 2011, HUD unveiled a new quarterly publication intended to inform housing and community development advocates, state and local policymakers, Congress and researchers on new approaches to issues related to housing and community development.
  Choice Neighborhoods: History and HOPE: The Winter 2011 issue of Evidence Matters addresses HUD's HOPE VI and Choice neighborhoods programs.
  HUD-VA Report on Veteran Homelessness in America: On February 10, 2011, for the first time ever, HUD and VA published the most authoritative analysis of the extent and nature of homelessness among American veterans. Nearly 76,000 veterans were homeless during the 2009 single night count. Veterans comprised 12% of the homeless count.
  Housing Choice Voucher Family Moves with Continued Assistance: On January 19, 2011, HUD issued Notice PIH 2011-3(HA). This notice provides guidance on PHA administrative responsibilities related to family moves with continued assistance within a PHA's jurisdiction and portability moves. In addition, the notice provides guidance for those situations where there is insufficient funding for a PHA to approve a family's move request.

  Exigent Health and Safety Correction Certification: On January 11, 2011 HUD published a Federal Register notice regarding its intent to extend reporting requirements regarding PHA certification of EHS corrections. The comment due date is February 10,2011.
  Fiscal Year 2010 Housing Choice Voucher (HCV) Funding Awards: On January 10, 2011 HUD published a Federal Register notice identifying awards to PHAs for non-competitive HCV funding awards for housing conversion actions, public housing relocations and replacements, and HOPE VI voucher awards.
  Asset Management E-Newsletter: The January issue is now available on-line. This issue discusses the Rental Housing Revitalization Act (HR 6468) which was introduced in Congress on December 1, 2010.
1/03/11 Resident Opportunities and Supportive Services (ROSS) Program Forms for Applying for Funding: On January 3, 2011 published a Federal Register notice regarding its intent to revise several of the forms used with the ROSS program. Comments are due by March 4, 2011.
  Over Subsidization in the Housing Choice Voucher Program: On January 1, 2011 HUD issued Notice PIH 2010-51 (HA). This notice extends with revisions Notice PIH 2009-22 (HA). Additional guidance is provided regarding subsidy standards and PIC reporting requirements in regard to live-in aides and their PHA-approved family members.
  Effective Use of the Enterprise Income Verification (EIV) System's Deceased Tenants Report to Reduce Subsidy Payment & Administrative Errors: On January 1, 2011 HUD issued Notice PIH 2010-50 (HA). This notice explains the procedures PHAs are required to implement to deal with families with deceased household members.
  Privacy Act System of Records - Disaster Housing Assistance Program (DHAP-IKE): On December 29, 2010 HUD published a Federal Register notice regarding its intent to create a new records system for DHAP-IKE. This new records system is the Efforts to Outcomes (ETO) system. The purpose of the ETO application is to capture and monitor pertinent data relating to family self-sufficiency, permanent housing status, service needs, and to facilitate on-going tracking and management of these services, leading to greater self-sufficiency for participants when DHAP-IKE ends. 12/31/10 Section 3 Implementation and Coordination Grant Application: On December 28, 2010 HUD published an information collection notice in the Federal Register regarding new forms to be used for competitive funding to be provided to eligible applicants (including PHAs) to pay for salaries for hiring a Section 3 Program Coordinator. The comment due date is February 28, 2011.
  Section 3 Reporting Forms - HUD 60002 and HUD 958: On December 28, 2010 HUD published a Federal Register notice regarding its intent to extend and/or revise two Section 3 forms. Form 958 is being revised to more accurately reflect the complaint investigation procedures set forth in the Section 3 regulation at 24 CFR part 135. No changes are proposed for form HIUD 60002. The comment due date is February 28, 2011.
  Housing Choice Voucher (HCV) program - Administrative fee Study: On December 28, 2010 HUD published an information collection notice in the Federal Register regarding information that will be collected on-site at 60 PHAs as part of a study of administrative fees for the HCV program. This is an emergency comment request with comments due January 27, 2011.
  Protecting Tenants at Foreclosure Act - Guidance on New Tenant Protections: On December 28, 2010 HUD issued Notice PIH 2010-49 (HA). This notice extends (with minor additions) Notice PIH -2009-52 which provides guidance to PHAs in the case of foreclosures, regarding protections for tenants with Section 8 assistance.
12/30/10 2011 Operating Funds: HUD has obligated initial operating subsidy funding for January 2011. The first round of funding is expected to be available in eLOCCS no later than January 1, 2011. The second round of funding will be provided by February 1, 2011.
  Regulatory Waivers Granted: On December 27, 2010, HUD published a listing in the Federal Register of regulatory waivers granted during the third quarter of calendar year 2010.
  PIH Notice Regarding Voluntary Conversion of Public Housing Units: HUD recently posted Notice PIH 2010-48 (PHA) which provides guidance to PHAs on preparing the market analyses for public housing property required as part of the voluntary conversion process.

  Operating Adjustment Cost factors for 2011: On November 8, 2010 HUD published in the Federal Register the 2011 operating cost adjustment factors (OCAF). OCAFs are annual factors used to adjust Section 8 rents renewed under section 524 of the Multifamily Assisted Housing Reform and Affordability Act of 1997. These OCAFs are effective starting February 11, 2011.

  Notice of Fund Availability (NOFA) for Choice Neighborhoods Initiative - Round 1: On November 2, 2010 HUD published a technical correction and extension of deadline date notice in the Federal Register regarding the NOFA for HUD's Choice Neighborhoods Initiative - Round 1. The application deadline date is extended at least 30 days to allow changes to the Mapping Tool used to determine neighborhood eligibility. HUD will post a new deadline date notice once the Mapping Tool has been revamped.

PTFA includes a requirement to provide tenants with at least 90 days' advance notice to vacate in the case of foreclosed properties. Section 703 of PTFA addresses the applicability to the Section HCV program.

  1. Remind PHAs of their continuing legal responsibility to ensure that a current DOT is recorded against all public housing project;
  2. Remind PHAs that they are to be in full compliance with DOT requirements; and
  3. Provide guidance on adding and removing public housing units and other property from the ACC.
  Use of Public Housing Capital Funds for Financing Activities: On October 21, 2010, HUD published a Final Rule in the Federal Register regarding the use of Capital Funds for financing activities. The effective date for the Final Rule is December 20, 2010. (Please note that the Final Rule only addresses the use of capital funds; it does not address the use of operating funds.)
  Continuation of Disaster Voucher Program (DVP) Housing Assistance Payments: On October 19, 2010, HUD issued Notice PIH 2010-43 (HA). This notice informs DVP administering PHAs that HUD will continue to provide monthly housing assistance payments for current DVP families. At this time HUD estimates there is sufficient funding to continue assistance for DVP Families through June 30, 2011.
  Exigent Health and Safety (EHS) Deficiency Correction Certification: On October 28, 2010 HUD published an information collection notice in the Federal Register regarding its intent to extend the reporting requirement for PHAs to certify the EHS deficiencies have been corrected. The comment due date is December 27, 2010.
10/19/10 Capital Fund Education and Training Community Facilities Program (CFCF): On October 8 HUD announced it is offering $35 million to PHAs to develop facilities that will provide early childhood and adult education, and/or job training programs for public housing residents. The application due date is January 14, 2011.
  Statutorily Mandated Designation of Difficult Development Areas and Qualified Census Tracts for 2011: On September 21, 2010 HUD published a Federal Register notice designating "Difficult Development Areas" (DDAs) and tables listing metropolitan and nonmetropolitan DDAs. This information is relevant for the LIHTC program.
10/18/10 Unit Data Certification for the Capital Fund Program: On October 13, 2010, HUD issued Notice PIH 2010-42 (HA). This notice advises PHAs of the requirement to certify to the accuracy of the data PHAs have submitted to HUD in the Inventory Management System of PIC. HUD will be using this data for the formula allocation of Capital Fund grants. HUD has yet to announce the due date for completing the certification process. We will keep you posted.
  Using Energy Star to Promote Energy Efficiency in Public Housing: On October 12, 2010 HUD issued Notice PIH-2010-41 (HA). This notice updates guidance encouraging Energy Star as the standard for PHAs. HUD is interested in promoting and expanding the use of energy-efficient equipment, appliances and standards in public housing in order to reduce energy consumption and control operating costs.
  Income Exclusion Under Temporary Employment by U.S. Census Bureau: On September 22, 2010 HUD issued Notice PIH-2010-38 (HA). This notice clarifies the exclusion of temporary employment payments by the U.S. Census Bureau pursuant to 24 CFR 5.609(c)(9). PHAs are to exclude temporary income payments from the U.S. Census Bureau, defined as employment lasting no longer than 180 days and not culminating in permanent employment. Employer verification of both the employment dates and income amount is to be maintained in the tenant file.

  Family Unification Program (FUP) - Notice of Funding Availability: HUD has posted the FUP NOFA which makes available approximately $15 million for new incremental voucher assistance through FUP. The application deadline date for this NOFA is December 1, 2010.
  Family Unification Program (FUP) - General Information: The Family Unification program provides Section 8 rental assistance for eligible families so that children will not be separated from their parents because of a lack of housing. The 2010 Notice of Funding Availability for the FUP program was recently published and applications are due by December 1, 2010.
  Set-Aside Funding Availability for Project-Basing HUD-Veterans Affairs Supportive Housing Vouchers (VASH): On September 28, 2010, HUD issued Notice PIH 2010-40 (HA). This notice informs VASH PHAs of approximately 500 project-based vouchers that are available through competitive funding. The notice provides guidance on the application process. The application due date is January 26, 2011.
  Process for PHA Voluntary transfers of Housing Choice Vouchers, Project-Based Vouchers and Project-Based Certificates: On September 28, 2010, HUD issued Notice PIH 2010-39 (HA). This notice provides information on the circumstances and process under which HUD will consider a voluntary transfer of budget authority and baseline units between PHAs under the Housing Choice Voucher program.
  Information Collection Notice - Rapid Re-Housing for Homeless Families Demonstration Program: On October 14, 2010 HUD published a Federal Register notice regarding proposed evaluation instruments and information collection requirements for the Rapid Re-Housing for Families Demonstration Program.   Changes to Grants.gov System: Grants.gov is doing a Security Build. The Security Build is an update to the Grants.gov system to comply with the National Institute of Standards and Technology security standards. The changes for the build will be available on October 11, 2010. Applicants will experience a number of system changes that include updates to passwords and logins, including:
  • New password requirements
  • 90-day password expiration
  • New change password option
  • Enhancements to "I Forgot My Password"
  • Account lockout for incorrect passwords
  • User roles removed after one year of inactivity

08/26/10 2010 Choice Neighborhoods and HOPE VI Notice of Fund Availability (NOFA)
On August 25, 2010 HUD published the NOFAs for the 2010 Choice Neighborhoods and HOPE VI programs. Applications for planning or implementation grants under the Choice Neighborhoods Program are due by October 26, 2010. Applications for the HOPE VI funding are due by November 22, 2010. Applications must be submitted electronically through www.grants.gov.
08/24/10 Enterprise Income Verification (EIV) Training
HUD will be offering updated EIV System and Security Awareness training on September 23. On September 24 HUD will offer initial EIV System training. This training will be offered via webcasts.
  Competitive Recovery Act Funds
On August 19, 2010 HUD issued Notice PIH 2010-34 (HA). This notice provides information and procedures for implementation of competitive capital funds Recovery Act grants.
  Non-Discrimination and Accessibility for Persons with Disabilities
On July 26, 2010 HUD issued Notice PIH 2010-26 (HA). The purpose of this notice is to remind recipients of Federal funds of their obligation to comply with pertinent laws and implementing regulations which mandate non-discrimination and accessibility in federally funded housing and non-housing programs for persons with disabilities.
  Requests for Applications under the Moving to Work (MTW) Demonstration Program
On July 30, 2010 HUD issued Notice PIH 2010-29 (HA). This notice offers eligible PHAs the opportunity to apply for admission to the MTW demonstration program.
  Transactions between PHAs and Their Related Affiliates and Instrumentalities
On August 2, 2010 HUD issued Notice PIH 2010-30. This notice carries forward previously issued guidance (PIH Notices 2009-24, 2008-27, and 2007-15) regarding PHA creation and use of affiliates and instrumentalities so t participate in Public and Indian Housing programs under the U.S. Housing Act of 1937.
  Designation of Public Housing Projects
On July 30, 2010 HUD issued Notice PIH-2010-28 (HA). This notice reinstates streamlined requirements for designating public housing projects for occupancy by elderly families only, or elderly and disabled families only.
08/11/10 Timely Reporting Requirements for Form HUD-50058
On July 7, 2010 HUD issued Notice PIH 2010-25 (HA). This notice establishes timeframes for timely reporting of form HUD-50058 into PIC. The notice also explains PIC modifications and clarifies Family Self-Sufficiency reporting requirements. HUD-50058 forms must now be reported in PIC within 60 days of any action recorded on line 2b of the form.
  Emergency Capital Funding Needs
On June 28, 2010 HUD issued Notice PIH 2010-24 (HA). This notice provides guidance to PHAs seeking Emergency Capital Needs funding for safety and security measures.
  Project-Basing VASH Vouchers

  Housing Discrimination Based on Sexual Orientation and Gender Identitys
On July 1, 2010 HUD announced a new policy that provides lesbian, gay, bisexual and transgender (LGBT) individuals and families with further assistance when facing housing discrimination. This new guidance treats gender identity discrimination most often faced by transgender persons as gender discrimination under the Fair Housing Act.

06/25/10 Project-Basing HUD-Veterans Affairs Supportive Housing Vouchers
On June 25, 2010, HUD issued PIH Notice 2010-23, regarding project-basing HUD-VASH vouchers. HUD and the Department of Veterans Affairs have decided to consider on a case-by-case basis, requests from PHAs to project-base vouchers in the HUD-VASH program. No more than 50 percent of vouchers are allowed to be project-based at any one time. The Veterans Affairs Medical Center should be consulted by the PHA prior to the submission of the PBV proposal to HUD for review.
06/24/10 Emergency Capital Needs - Emergency Security and Safety Funding
On June 24, 2010, HUD issued PIH Notice 2010-24 to guide PHAs in acquiring Emergency Capital Needs funds for safety and security measures. The two situations in which these funds would be given were determined by Congress to include emergencies and non-presidentially declared natural disasters occurring during FFYs 2009 and 2010. Congress appropriated 20,000,000 in both years to provide assistance for these two approved scenarios.

  Questions and answers from PIC/EIV/VMS Session at Colorado NAHRO Conference
  USDOT and HUD Launch Collaborative Effort to Create Sustainable, Livable Communities - HUD and the Department of Transportation (DOT) announced the first ever joint federal grant between the two agencies. The departments will award up to $75 million in funding for localized planning activities that lead to projects that integrate transportation, housing and economic development. HUD's Sustainable Communities funding will target projects that foster reform and reduce barriers to achieving affordable, vital and sustainable communities.

Pre-applications are due 30 days from the publication of the NOFA in the Federal Register. Full applications are due on August 23. State and local governments, transit agencies, and others, are eligible to apply for funding. For more information, please review the notice of funding availability (NOFA).

04/15/10 Newly Revised Section 8 HAP Contract: HUD recently revised the Section 8 HAP Contract, Form HUD-52641 (8/2009). Key revisions to the HAP Contract include a foreclosure provision for the successor in interest in the property and a provision for the automatic termination of the HAP contract upon the death of a single member household. The revisions include the addition of Paragraphs 4b(6) and 15 to Part B; modifications to Paragraph 7a(3) of Part B; and the addition of Paragraphs 8(d)(4)-(5) to Part C. Previous editions of the HAP Contract are obsolete.
04/09/10 Quality Control for Rental Assistance Subsidy Determinations On April 8, 2010, HUD published a Federal Register notice regarding its intent to conduct future quality control studies on rental assistance calculations. 04/07/10 6/30/09 Audit Submission Due Date Extended HUD has extended the due date to April 30, 2010 for PHAs with a FYE 6/30/09 to submit their audit reports to HUD via the FASS system. Normally these audits are due no later than March 31, 2010. Please note that this extension does not apply to Circular A-133 submissions to the Federal Audit Clearinghouse.
  EIV Recertification for PHA Users PHAs can recertify staff for EIV starting April 1, 2010. However, due to the upcoming EIV release (scheduled to be available April 19), PHAs are requested to not recertify users until Monday, April 19, 2010. PHAs are also advised that effective April 19, 2010, PIH EIV users will now require certification only semi-annually (versus quarterly) - every April and October.
  EIV User Training PHAs are reminded that the use of HUD's EIV system is now mandatory for all PHAs and all users must have EIV training. The deadline of April 29, 2010 for completion of the of the PIH RHIIP/EIV training session (webcast of January 28, 2010), has been extended to October 30, 2010.
  Effective Use of the EIV System's Deceased Tenants Report to Reduce Subsidy Payment and Administrative Errors On March 30, 2010, HUD issued Notice PIH 2010-9 (HA). This notice explains the procedures PHAs are required to implement to deal with families with deceased household members.

  HQS Inspections for the Housing Choice Voucher Program and Guidance related to Electrical Outlets On March 31, 2010 HUD issued Notice PIH 2010-10 (HA). This notice reviews the existing HQS requirements and existing guidance that PHAs may rely upon when conducting inspections. The notice also offers additional guidance on what types of three-prong electrical outlets an inspector should consider acceptable under HQS.
  Renewal of Project-Based Housing Assistance Payments Contracts On March 26, 2010 HUD issued Notice PIH 2010-8 (HA). This notice provides guidance on the renewal of project-based HAP contracts.

  HUD Initiative for the Removal of Regulatory Barriers On March 25, 2010 HUD published an information collection notice in the Federal Register notifying the public of its intent to extend form HUD-27300. This form is submitted by grant applicants to obtain higher rating points based on association with successful efforts to remove regulatory barriers which may impede the production of affordable housing. The comment due date is May 24, 2010.

04/05/10 Health Care for Residents of Public Housing National Training Conference - June 28-30 Register for the National Center for Health in Public Housing's two and a half day conference in Boston featuring keynote speaker Assistant Secretary Sandra Henriquez. The high prevalence of health issues among residents of public housing creates significant impediments to their gaining and maintaining employment, and achieving self-sufficiency. This conference will highlight the ways health centers are working with housing authorities to address these issues and improve the lives of residents. HUD staff presentations will include: HUD Funding Opportunity: Learn More About the Resident Opportunity and Self-Sufficiency (ROSS) Grant and Healthy Living in Public Housing: Innovative Programs and Interagency Partnerships. 03/10/10 Changes in Unit Reporting in Public Housing Information Center (PIC) On March 8, 2010 HUD issued Notice PIH 2010-6 (HA). This notice explains PIC changes from the May 2008, October 2008, and September 2009 PIC releases that affect unit status reporting. In addition, PHAs are reminded that HUD approval is needed for the following categories of approved vacancies: Vacant Undergoing Modernization, Special Use Units, Vacant as a Result of Court Litigation, Vacant due to Natural Disaster, and Vacant due to Casualty Loss.

02/22/10 MASS Certification for PHAs During Transition Year 2, which includes PHAs with FYE 6/30/09, 9/30/09, 12/31/09, and, 3/31/10. PHAs will receive a PHAS score. Small PHAs will be assess every other year per 24 CFR 902.9. HUD has posted a Mass certification schedule for small PHAs. The due date for MASS certifications during Transition Year 2 for 6/30/09, 9/30/09 and 12/31/09 PHAs is 3/13/10. For 3/31/10 PHAs it is 5/30/10.
02/18/10 2010 Housing Choice Voucher (HCV) Funding Notice On February 16, 2010 HUD issued Notice PIH 2010-5 (HA), Implementation of the Federal Fiscal Year 2010 Funding Provisions for the Housing Choice Voucher Program. This notice explains how the $18,184,200,000 appropriated by Congress for the 2010 HCV program will be allocated for HAP renewal, administrative fees and other items. Please note that the administrative fee paid for PHA-owned units will now be paid at the same rate as for non-PHA-owned units. PHAs are advised to pay close attention to the eligibility and submission requirements for funding under the $150 million set-aside. Submissions are due by March 9, 2010. Finally PHAs should note: There is no additional funding to assist PHAs that experience a shortfall during 2010.
  Guidance to Assist PHAs in Completing SF-424 for Operating Funds HUD has posted guidance on its web page to assist PHAs in completing SF-424, Application for Federal Assistance, for a PHA's 2010 operating fund program. Please note:
  • In SAGIS, the SF-424 form is a required attachment and must be uploaded for each project submission. However, the PHA needs to complete only one SF-424 for the PHA and then attach the same form to each of its project submissions.
  • PHAs that have already completed their 2010 submissions in SAGIS do not need to resubmit with a revised SF-424 even if they did not complete the form using this guidance.
HUD has also posted a fillable SF-424 PDF that is the most current version of the SF-424.

  Enterprise Income Verification (EIV) System User Access Authorization Form and Rules of Behavior and User Agreement On January 26, 2010 HUD published a notice in the Federal Register regarding its intent to implement new forms for identifying persons and agencies that will have access to the EIV system. Comments are due February 25, 2010.
  Multifamily Tenant Characteristics Family Reporting On February 3, 2010 HUD published an information collection notice in the Federal Register regarding its intent to extend the information collection requirements with Form HUD-50058. Comments are due April 5, 2010.

  Sustainable Communities Planning Grant Program On February 10, 2010 HUD published a Federal Register announcing its intent to offer funding through a NOFA competition for its Sustainable Communities Planning Grant program. This is a new program and is being initiated in close coordination with Department of Transportation and the Environmental Protection Agency. This notice request public comments. This is an excellent opportunity to provide input as the program and NOFA is being designed. The comment due date is March 12, 2010.
  Maintenance Wage Rates On January 26, 2010 HUD published a notice in the Federal Register regarding its intent to make revisions to several maintenance wage rates forms: HUD-4750, HUD-4751, HUD-4752 and HUD-4230-A. Comments are due February 25, 2010.
  Public Housing Contracting with Resident-Owned Businesses On February 3, 2010 HUD published a notice in the Federal Register regarding its intent to extend information collection requirements regarding PHAs contracting with resident-owned businesses. Comments are due April 5, 2010.
  2010 Annual Adjustment Factors for Section 8 Moderate Rehabilitation and SRO Projects On February 10, 2010 HUD published a notice in the Federal Register for revised contract rent annual adjustment factors (AAF) for the Section 8 Moderate Rehabilitation and SRO programs. The effective date for these AAFs is February 10, 2010.
  2010 Annual Adjustment Factors for Section 8 Housing Assistance Payments (HAP) Program On February 10, 2010 HUD published a notice in the Federal Register for revised HAP renewal annual adjustment factors (AAF) for a PHA's Housing Choice Voucher program. The effective date for these AAFs is February 10, 2010.
  Weatherization Assistance Program for Low-Income Persons On January 25, 2010 the Department of Energy published a Final Rule in the Federal Register regarding its Weatherization Assistance Program for Low-Income Persons. Among other things the Final Rule addresses the eligibility of multi-unit buildings receiving HUD assistance. This Final Rule is effective February 24, 2010. PHAs are encouraged to review the Final Rule to see if this program would be beneficial.
  Announcement of Funding Awards for Fiscal Year 2009 for the Housing Choice Voucher (HCV) Program On February 5, 2010 HUD published a Federal Register notice identifying the PHAs receiving 2009 funding for non-competitive funding awards for housing conversion actions, public housing relocations and replacements, moderate rehabilitation replacements, and HOPE VI voucher awards.
01/25/10 HUD Consent for Eminent Domain Activities On January 22, 2010 Notice PIH-2010-4 was issued. This notice extends Notice PIH-2009-01 (PHA) for another year. The purpose of the notice is to provide guidance on the factors that HUD will consider in determining whether to consent to an agreement between a PHA and a governmental entity using eminent domain authority regarding the taking of public housing property that was developed/acquired by, or is maintained with fund form the U.S. Housing Act of 1937.
  Due Date Extension for 2009 HOPE VI Main Street Grants Programs On January 22, 2010 HUD published a Federal Register notice extending the due date to March 31, 2010 for applications under the 2009 HOPE VI Main Street Program NOFA.
  Calendar Year 2020 Operating Fund Appeals Notice PIH 2010-2(HA) was issued on January 20, 2010. This notice provides guidance for the submission of 2010 operating fund appeals. Appeal submissions must be submitted (postmarked) by May 14, 2010.

01/12/10 Public Housing Assessment System (PHAS) Scoring for Asset Management Transition Year 2 On January 12, 2010 HUD published a Federal Register notice which provides guidance on PHAS scoring for PHAs with fiscal years ending 6/30/09, 9/30/09, 12/31/09, and 3/31/10. Please note the guidance regarding PHAS scoring of small PHAs; the requirement to submit management operations certifications; and the PHA options for the resident assessment indicator scoring.
01/06/10 Non-Discrimination and Accessibility for Persons with Disabilities On January 5, 2010 HUD issued Notice PIH 2010-2 (HA). The purpose of this notice is to remind recipients of Federal funds of their obligation to comply with pertinent laws and implementing regulations which mandate non-discrimination and accessibility in federally funded housing and non-housing programs for persons with disabilities.
  Extension of the Disaster Voucher Program (DVP) On January 5, 2010 HUD issued Notice PIH 2010-1 (HA). This notice provides notification that the DVP has been extended to September 30, 2010. This extension applies only to those families receiving DVP assistance and does not permit any additional families to be admitted to the program.
12/31/09 2010 Operating Subsidy HUD has made available in eLOCCS one month of operating subsidy for 2010. By February 1, 2010 a second round of funding will be obligated to cover a 4-month period from February through May. HUD has also posted on its web page an explanation of how subsidy amounts were calculated.
  HUD Waiver Requests A listing of waiver requests approved by HUD during the third quarter of 2009 was published in the Federal Register on December 31, 2009.
  Final Rule - Refinement of Income and Rent Determination Requirements in Public and Assisted Housing Programs in Public and Assisted Housing Programs: Implementation of the Enterprise Income Verification (EIV) System-Amendments This Final Rule was published in the Federal Register on December 29, 2010. This rule requires:

  1. All PHAs to use the EIV system during all annual and interim re-exams.
  2. Applicants and tenants to disclose their Social Security number.
  3. PHAs to transmit to HUD and to retain form HUD-50058 and supporting documentation for all assisted families to support billings to HUD and permit an effective audit.
The Final Rule is effective January 31, 2010.
  December 2009 Voucher Management System (VMS) Reporting Requirements The reporting period for December 2009 VMS data will be from January 16-29, 2010.
  Disaster Housing Assistance program (DHAP) Follow-up Contact On December 18, 2009 HUD published an information collection notice in the Federal Register regarding its intent to undertake follow-up contact with respondents to a previous DHAP survey. Comments are due by January 4, 2010.

The Desk Guide summarizes the responsibilities and requirements that PHAs must comply with to convert their public housing stock to tenant-based assistance under Section 8 of the United States Housing Act of 1937.
12/16/09 Protecting Tenants at Foreclosure Act On December 15, 2009 HUD issued PIH Notice 2009-52 (HA). This notice provides guidance to PHAs in the case of foreclosures, regarding new protection for tenants with Section 8 assistance that was recently enacted into law by the Helping Families Save their Homes Act of 2009 and the American Recovery and Reinvestment Act of 2009.
  Federal Labor Standards Payee Verification and Payment Processing On December 16, 2009 HUD published an information collection notice in the Federal Register notifying the public of its intent to extend form HUD-4734, Labor Standards Deposit Voucher. Comments are due by February 16, 2010.
  Rent Reasonableness Notice On December 11, 2009 HUD issued PIH Notice 2009-51 (HA). This notice provides guidance on the rent reasonableness requirements in the Housing Choice Voucher program.
  HUD Actions in Support of President Obama's Open Government Initiative In a December 9, 2009 press release, HUD announced activities in support of President Obama's open government initiative which has a goal to make information more accessible to the general public. HUD will publish online historical detailed information of the physical condition of public housing and multifamily units. HUD will also offer citizens the opportunity to contribute to HUD's long-term strategic plan through a new interactive suggestion box.

  Public Housing Mortgage Program On December 11, 2009 HUD published a Federal Register notice informing the public that it has posted on its web page a proposed notice that proposes the terms and conditions by which PHAs may mortgage their public housing real estate assets to secure financing to undertake development and rehabilitation of low-income housing with HUD approval. Comments on the proposed notice are due January 31, 2010.

  Proposed Allocation Rule for Housing Trust Fund On December 4, 2009 HUD published in the Federal Register a proposed rule for allocation funding under HUD's Housing Trust Fund. The purpose of this fund is to provide grants to States is to preserve and increase the supply of rental housing and to increase homeownership opportunities for extremely low- and very low-income families. The comment due date is February 2, 2010.
  Appealing REAC Physical Inspection Scores Are you unhappy with your REAC Physical Inspection score and feel that the inspection was not accurate? You can appeal your inspection; however, you will need to fully justify and document your reason(s) for the appeal/Database Adjustment. You will need to submit your request for Database Adjustment to our office as soon as possible after the inspection, and the request must be received in our office within 15 days from the date the inspection report was released. Once the request for database adjustment is received in our office, we will do a thorough review of your request and if we concur, we will send a letter to REAC with our concurrence and the reason(s) of our concurrence.

Among other things, this notice addresses: (1) statutory and regulatory requirements for PHAs administering CSSR; (2) data collection and reporting requirements; and (3) PHA action to take against non-compliant tenants.

Capital Fund Certifications are due by December 31, 2009 HUD has opened the Capital Fund Certification process for FFY 2010. PHAs are asked to review their data and certify to the accuracy by December 31, 2009. The effective date for the data to be certified is September 30, 2009. Public Housing Operating Subsidy Calculations for Calendar Year 2010 On November 19, 2009 HUD issued notice PIH 2009-47 (HA) which provides instructions for 2010 operating subsidy calculation submissions. 2010 operating subsidies will be processed using SAGIS. The deadline date for all 2010 subsidy submissions is March 1, 2010.

Tracking Data Collection Instrument for Neighborhood Networks On November 19, 2009 HUD published an information collection notice in the Federal Register regarding the Neighborhood Networks program. HUD is requesting clearance for a revision of a current data collection designed to capture information from the Neighborhood Networks center paper and START business plans.   Renewable Energy and Green Construction Practices in Public Housing: On October 16, 2009 HUD issued PIH Notice 2009-43 (HA). This notice encourages PHAs to use renewable energy sources and other "green" construction and rehab techniques whenever they procure for maintenance, construction or modernization.
  Calendar Year 2010 Operating Subsidy Procedures: HUD has notified PHAs to use the Subsidy and Grants Information System (SAGIS) for submission of calendar year 2010 operating fund calculations. SAGIS will open on December 7, 2009 for PHAs with more than 1000 units and will open on January 11, 2010 for PHAs with fewer than 1000 units. The deadline for all submissions is March 1, 2010.
  Operating Subsidy Stop-Loss and Appeals Forms: On October 29, 2009 HUD published an information collection notice in the Federal Register extending the applicability of the stop loss packages that may be submitted by PHAs. Comments are due by November 30, 2009.
  Voluntary Conversion of Public Housing Units: On October 13, 2009 HUD issued PIH Notice 2009-42 (HA) which provides guidance on the market analysis required for the voluntary conversion of public housing units.
  Cost-Savings Measures in the Housing Choice Voucher (HCV) Program: On October 23, 2009 HUD issued PIH Notice 2009-44 (HA). This notice provides guidance on actions PHAs may take to address financial shortfalls by reducing costs in the HCV program. The notice also provides guidance as to when a PHA may deny a portability request or terminate assistance due to insufficient funding.
  2009 Administrative Fee Funding for HCV FSS Coordinators: On September 29, 2009 HUD issued PIH Notice 2009-40 which explains how HUD will distribute FY 2009 HCV/FSS Administrative Fee funding to PHAs.

10/07/09 Housing Choice Voucher Program (HCV) Satellite Broadcast: On October 8, 209, from 12:00 p.m. to 2:00 p.m., MST, HUD will host a broadcast on the HCV program. Topics to be covered include VMS enhancements, 2010 funding implementation, and cost saving measures. Information on the webcast should be posted soon.
  Fiscal Year 2010 Fair Market Rents (FMR): The 2010 FMRs were published in the Federal Register on September 30, 2010.
  Prohibition on PHAs Charging Application Fees: On September 25, 2009 HUD issued Notice PIH 2009-39 (HA) which reiterates HUD's long-standing policy that PHAs may not charge application fees to persons or families applying for the Public Housing or Housing Choice Voucher Programs.
  PHA Audited Financial Submissions to Local Field office: On September 22, 2009 HUD issued Notice PIH 2009-38 (HA) which reimposes the requirement that PHAs provide to the local field office one copy of the completed audit report package and the Management Letter issued by the Independent Auditor.
  Treatment of American Recovery and Reinvestment Act (ARRA) Income Received by HUD Program Participants: On September 24, 2009 HUD issued Notice PIH 2009-37 (HA). This notice clarifies that the ARRA one-time $250 recovery payment to beneficiaries of Social Security, Supplemental Security Income, certain railroad retirement programs, and Veterans retirement and disability programs, is not included by a PHA as income when an income determination is calculated during mandatory interim and annual reexaminations.
  EIV 9.0 and Refinement of Income Rule Training is Now Available: The archived webcast of the September 24, 2009 webcast and the training materials are now available on-line. Remember: Effective January 31, 2010 all PHAs are required to use EIV.
  Debts Owed to PHAs and Terminations: One of the recent enhancements to the Earned Income Verification System (EIV) is the feature for PHAs to report debts owed to the PHA by former tenants. This feature is now turned on EIV. PHAs must first view the September 24, 2009 webcast in order to use this feature. PHAs are not required to enter debt/termination information in EIV until there is an OMB number and expiration date displayed on the Debts Owed & Terminations Notice Page. Any information entered by the PHA is done so voluntarily. On October 2, 209 HUD published an information collection notice that starts the process for getting an OMB number for this new reporting requirement. Comments are due December 1, 2009.
  2009 Final Operating Fund Obligations and Proration: Final 2009 operating fund obligations for October - December 2009 have been obligated and the funds loaded into eLoccs. The final proration factor for 2009 is 88.42%.
  Final Calendar Year 2009 Operating Subsidy Obligation - Reconciliation Methodology: HUD has posted guidance explaining the methodology HUD used to reconcile final operating fund eligibility with amounts previously obligated. The guidance also includes HUD's recommendation as to how PHAs should report subsidy amounts for purposes of PHA year-end financial reporting.
  Housing Quality Standards (HQS) Inspection Bulletin: The HUD Philadelphia Field office created the attached HQS Inspection Bulletin which we believe you may find helpful. The bulletin consists of a summary of common deficiencies observed by the Office of Inspector General (OIG) during audits of five Section 8 Housing Choice Voucher Programs in eastern Pennsylvania and Delaware that OIG recently conducted. The bulletin also includes a summary of the most common findings made by OIG as a result of its audits.
09/22/09 National Exceptions to Buy American Requirements for Public and Indian Housing Recovery Act Funds On September 11, 2009 HUD published a Federal Register notice that addresses five exceptions to the Buy American requirements. PHAs will want to make sure they are fully knowledgeable and understand the Buy American requirements under Section 1605 of the Recovery Act. If you have any questions please contact your Facilities Management Specialist.
  Recovery Act Management and Performance System (RAMPS) PHAs will be using RAMPS for environmental review reporting requirements pursuant to Section 1609 of the Recovery Act. Please be sure to check out frequently HUD's reporting guidance and resources which can be found in the resources section of the HUD Recovery Act reporting page. In addition to the mandatory reporting requirements please remember the optional reporting information that HUD requested in a September 3, 2009 email to PHAs.   Environmental Review Reporting Requirements under the Recovery Act On September 9, 2009 HUD published a Federal Register notice addressing electronic reporting of environmental review information under the Recovery Act. Comments are due by November 9, 2009.
  2009 Capital Fund Program (CFP) On September 2, 2009, HUD issued Notice PIH 2009-33 (HA) which provides important guidance and key processing dates for the 2009 CFP program. PHAs receiving CFP funds need to be aware of this information contained in this notice.
  New FASS Release Information about the September 2009 release is now available on-line.
  Supplemental Asset Management Financial Reporting Information - Transition Year 1 On September 8, 2009 HUD issued Notice PIH 2009-34 (HA). This notice extends the deadline due date fur submission of audited financial information. For PHAs with fiscal years ending June 30, 2008, through March 31, 2009, HUD will accept these audit reports within 12 months of the end of the PHA's fiscal year.
  Updated Voucher Management System (VMS) User's Manual An updated (September 2009) VMS User's Manual is now available.
  Form HUD-92006 Supplement to Application for Federally Assisted Housing On September 15, 2009, HUD issued Notice PIH 2009-36 (HA). This notice addresses new requirements for PHAs where PHAs must provide applicants as part of their application for housing, the option to include information on an individual or organization that may be contacted to assist in providing any delivery of services or special care to applicants who become tenants and to assist with resolving any tenancy issues arising during tenancy. The notice also transmits Form HUD-92006 which PHAs must now include as part of their application process.
  State Lifetime Sex Offender Registration On September 9, 2009 HUD issued Notice PIH 2009-35(HA). This notice reiterates current regulatory requirements and strongly encourages the establishment of standards and processes with a zero tolerance approach to prevent lifetime sex offenders from receiving federal housing assistance.
  Neighborhood Networks Management and Tracking Data Collection Instruments On September 8, 2009 HUD published a Federal Register notice addressing a proposed semi-electronic postcard collection of information from Neighborhood Network centers. Comments are due by November 9, 2009.
  Regulatory Waivers Granted On September 16, 2009, HUD published in the Federal Register a listing of all regulatory waivers granted during the second quarter of calendar year 2009.
09/03/09 Stop-Loss Appeals On September 2, 2009 HUD published an information collection notice in the Federal Register regarding information reporting requirements for stop-loss appeals for operating fund. The comment due date is November 2, 2009.
  Enterprise Income Verification (EIV) System Changes On September 1, 2009 HUD published a notice in the Federal Register regarding changes to the EIV system. The notice also informs the public of what information is collected and how this information is used and by whom. Please note that starting September 14 PHAs will be able to enter into EIV the amount of debt owed by a former tenant. This proposal shall become effective, without further notice, October 1, 2009, unless comments are received prior to October 1 which would result in a contrary determination.
09/01/09 Reporting Requirements under the Recovery Act PHAs receiving Recovery Act funding can now register for the government wide Recovery Act reporting system. PHAs are encouraged to register now so they will be ready to submit reporting information. Reporting begins October 1 and must be completed October 9, 2009.
  HUD's Recovery and Management Performance Systems (RAMPS) In addition to federal reporting under the Recovery Act, PHAs will also have to report under HUD's Recovery and Management Performance System (RAMPS). To log into RAMPS you will need a password and ID, e.g., M number plus password. Please follow the steps for registering access to RAMPS. Some of the information that will be reported under RAMPS is the status of environmental compliance review actions. We will keep you posted of reporting requirements under the Recovery Act.
  Buy American Requirements On August 21, 2009 HUD issued notice PIH 2009-31 (HA), PIH Implementation Guidance for the Buy American Requirement for the American Recovery and Reinvestment Act of 2009 including Process for Applying Exceptions. All PHAs receiving Recovery Act funds will want to become familiar with this notice and the guidance it contains. Please pay close attention to the national exceptions (see page 7 of the notice) and the requirement that PHAs must have documentary evidence in their procurement records. Please contact your Facilities Management Specialist with any questions.
  Update on Refinement of Income and Rent Rule On August 28, HUD published a Federal Register notice delaying the implementation date for the Refinement of Income and Rent Determination Requirements in Public and Assisted Housing programs. The effective date of this rule is delayed until January 31, 2010.
  Use of Project Labor Agreements for Federal Construction Projects On August 28, 2009 HUD published a Final Rule in the Federal Register. The Final Rule removes a regulation that prohibits the use of project labor agreements in HUD-assisted construction contracts. This removal was necessary as a result of Executive Order 13502 which was signed by President Obama on February 6, 2009. The effective date for the Final Rule is September 28, 2009.
  Year 4 Stop Loss Applications On August 26, 2009 HUD issued Notice PIH 2009-32 (HA), Operating Fund Program: Guidance on Demonstration of Successful Conversion to Asset Management to Discontinue the Reduction of Operating Subsidy, Year 4 Applications. This notice provides guidance for PHAs which wish to submit stop loss applications during year 4 and can demonstrate a successful conversion to asset management. These stop loss applications must be submitted by October 15, 2009.
  Maintenance Wage Rate Forms On August 26, 2009, HUD published an information collection notice in the Federal Register. HUD intends to extend several forms used by HUD and grantees/recipients to ensure compliance with maintenance wage rate requirements. Comments are due by October 26, 2009.
  Declaration of Trusts (DOTs) On August 14, 2009 HUD issued notice PIH 2009-28 (HA) which addresses DOT requirements for property acquired with HUD funds. PHAs have a continuing legal responsibility to ensure that a current DOT is recorded against all of their public housing property.
  Moving to Work (MTW) Demonstration Program On August 19, 2009, HUD issued notice PIH 2009-29 (HA), Request for Applications under the Moving to Work Demonstration Program. Page 2 of the notice identifies those PHAs that are eligible to apply pursuant to the criteria set forth in the notice.
  Disaster Information System (DIS) In the August 18, 2009 Federal Register HUD notified the public that it intends to establish a new record system - DIS. DIS will contain information on families who apply for and are determined by FEMA to be eligible to receive disaster housing assistance after a presidentially declared disaster. Comments are due by September 17, 2009.
  Operating Budget Form (HUD-52574) On August 17, 2009 HUD published an information collection notice in the Federal Register informing the public that it plans to extend form HUD-52574. Most PHAs do not have to submit their operating budgets to HUD. Comments are due by October 16, 2009.
08/05/09 $100 Million HAP Set-Aside Funds Still Available On August 4, 2009 HUD issued PIH Notice 2009-26(HA), Implementation of the Federal Fiscal Year 2009 Funding Provisions for the Housing Choice Voucher Program - Award of Remaining Set-Aside Funds. This notice addresses the procedures HUD will follow in the award of the remaining 2009 set-aside funds for HAP costs under the Housing Choice Voucher program.
  Award Announcement for Rental Assistance for Non-Elderly persons with Disabilities in Support of Designated Housing Plans for Fiscal year 2008 In the August 5, 2009 Federal Register HUD announced those PHAs awarded funding for FY 2008.
08/04/09 Proposed 2010 Fair Market Rents (FMR) HUD published the proposed 2010 FMRs in a Federal Register notice on August 4, 2009. The proposed FMRs would be effective October 1, 2009. The FMRs are used to determine payment standard amounts for the Housing Choice Voucher program. The Federal Register notice states HUD is considering reforms and several changes to the methodology for calculating FMRs that are not reflected in the published proposed FMRs. HUD will publish a separate Federal Register notice describing and depicting examples of a number of reforms and improvements to the methodology for estimating FMRs. At this time HUD is seeking public comments suggesting items for consideration in the subsequent notice. The comment due date is September 2, 2009.
  2009 Housing Choice Voucher (HCV) Program Funding Shortfalls On July 31, 2009 HUD issued a press release regarding additional funds made available to assist PHAs facing funding shortfalls that may limit them from serving families participating in the HCV rental assistance program. So far, $89 million has been made available and in the coming weeks HUD will award another $11 million. In a July 31, 2009 letter PHAs were asked to submit an email by August 14 if they suspect their available funding will force them to terminate families. This email message should be sent to: pih.financialmanagement.division@hud.gov. Our office would also appreciate receiving a copy of any email messages submitted.
  Recovery Act Frequently Asked Questions (FAQ) On July 24, 2009 HUD issued a third set of FAQs addressing project needs assessments and procurement under the American Recovery and Reinvestment Act. Please be sure to check out this latest guidance.
  PIH Notice 2009-25, Energy Investment Guidance Under American Recovery and Reinvestment Act (Recovery Act) of 2009 This notice was issued July 30, 2209 and it provides energy investment guidance to PHAs regarding Recovery Act funds.
  Reminder: Applications for 2009 funding for the Public Housing Family Self-Sufficiency Program Due by August 11, 2009.
  Fiscal Year 2009 ROSS Service Coordinators (SC) Webcast A webcast on the 2009 ROSS-SC NOFA is scheduled for August 12, 2009, 11:00 - 12:30 EST. Applications under this NOFA are due September 18, 2009.
  July 2009 Voucher Management System (VMS) Reporting VMS will be open starting August 4 for reporting of July data. PHAs have until August 22 to complete their data reporting. Please be sure to pay close attention to the recent guidance issued by the Financial Management Division regarding reporting requirements for PHA-Owned units.
  Proposed FY 2010 Fair Market Rent (FMR) Documentation System This HUD system provides complete documentation of the development of the proposed FY 2010 FMRs for any area of the country selected by the user.
07/23/09 Notice of Funding Availability (NOFA) for Resident Opportunity and Self-Sufficiency (ROSS) Programs
On July 22, 2009 HUD notified the public via the Federal Register that HUD has posted on its web page the 2009 NOFA for funding under the Resident Opportunity and Self-Sufficiency (ROSS) Service Coordinators Program. The NOFA makes approximately $28 million available from HUD's 2009 budget. Applications are to be submitted electronically and are due September 18, 2009. A webcast with details will take place on August 12, 2009, at 11am ET.
  Extension and Revision of Guidance on Over-Subsidization in the Housing Choice Voucher (HCV) Program On July 21, 2009, HUD issued PIH Notice 2009-22 (HA) extending and revising PIH Notice 2008-20 (HA) on Over-subsidization in the Housing Choice Voucher (HCV) Program. The section in regard to occasional, intermittent, multiple or rotating care givers has been modified and a section has been added in regard to reasonable accommodation for medical equipment.
  Extension of Notice PIH 2008-10 (HA) - Requirement for Designation of Public Housing Projects On July 21, 2009, HUD issued PIH Notice 2009-23 (HA) extending Notice PIH 2008-10 (HA), which expired on January 31, 2008. The Notice reiterates the streamlined requirements for designating public housing projects for occupancy by elderly and/or disabled families.
07/22/09 Training for Housing Choice Voucher (HCV) Program. HUD will provide a two-day training on financial reporting and accounting related to the HCV Program for PHA Accountants, Fee Accountants, CPAs, and HUD staff. Training will be held this summer in Seattle, Chicago, and Philadelphia. Training sessions are provided free of charge, however participants are responsible for providing lodging, travel, and meals.   Notice encouraging Non-Smoking Policies in Public Housing On July 17, 2009 HUD issued PIH Notice 2009-21 (HA) strongly encouraging Public Housing Authorities (PHAs) to adopt non-smoking policies in some or all of their public housing units. Because Environmental Tobacco Smoke (ETS) can migrate between units in multifamily housing, causing respiratory illness, heart disease, cancer, and other adverse health effects in neighboring families, the Department is encouraging PHAs to adopt non-smoking policies.
  Guidance on the Asset-Repositioning Fee (ARF) and Re-occupying Public Housing Units Proposed or Approved for Demo/Dispo or Transition to Home Ownership PIH Notice 2009-20 (HA) was issued on July 17th and provides guidance on the implementation of the asset-repositioning fee (ARF) and on re-occupying public housing units proposed or approved for demolition, disposition, or transition to home ownership.
  Notice of Fund Availability (NOFA) for 2009 HOPE VI Revitalization Grants Program On July 14, 2009 HUD notified the public via the Federal Register that HUD has posted on its web page the 2009 NOFA for HOPE VI funding under the Revitalization Program. The NOFA makes approximately $113 million available from HUD's 2009 budget.
  2008 Annual Homeless Assessment Report to Congress Notice of Buy American Exception Under the American Recovery and Reinvestment Act of 2009 On June 30, 2009, HUD notified the public via the Federal Register that an exception to the Buy American requirements of the Recovery Act was determined applicable to the Boston Housing Authority's construction of a project using Recovery Act Funds.

  Revised Capital Fund Recovery Competition (CFRC) NOFA HUD has issued a revised NOFA that supersedes the NOFA published on May 7, 2009. This revised NOFA contains a modified schedule for threshold-based applications (Categories 1, 2, and3). There are no schedule changes for Category 4 applications.
06/02/09 Recovery Act Competition Application Kit Map HUD has published on its web page application kits to aid PHAs applying for funding under the Capital Fund Recovery Act Competitive program. All PHAs should also have received notification that HUD is moving the first date of submission of applications under HUD's FY 2009 NOFA for the Capital Fund Recovery Competition grants from June 1, 2009, to June 16, 2009 for the purpose of incorporating certain changes that applicants will need the opportunity to consider before submitting their applications.
  2009 Housing Choice Voucher (HCV) Homeownership Program Guidebook HUD has developed a new guidebook to provide assistance to PHAs that are thinking about starting a homeownership program as well as to assist PHAs who have taken the first tentative steps and are wondering what to do next. The guidebook provides a hands-on approach to program development, and provides resources that will be helpful to PHAs in identifying and resolving program issues.
  Deadline Extended to June 4, 2009 for Submission of HAP Set-Aside Funding Requests HUD has extended the May 22, 2009 deadline date for submission of PHA requests for additional renewal funds from the $100 million set-aside of Housing Assistance Payments funds. PIH Notice 2009-13 provides guidance on submission requirements.
  HAP Set-Aside Funding for Additional Leasing HUD's 2009 appropriations provided a $100 million set-aside for additional HAP renewal funding to PHAs under certain circumstances. (See PIH Notice 2009-13.) One of the categories provides additional funding for PHAs who experienced an increase in voucher leasing during the final quarter or final month of calendar year 2008, because this increased leasing is not captured in the costs for the rebenchmark period. HUD has completed preliminary calculations of eligibility for funding under this category and has identified apparently eligible PHAs. These PHAs must submit a request by June 4 in order to be funded. If a PHA is not on this list but the PHA thinks it may be eligible , the PHA should submit a request. Be sure to check out the second and third "What's New" items on HUD's HCV web page.

Supplement to Application for Federally Assisted Housing
This May 19, 2009 Federal Register notice informs the public of the requirement for housing providers participating in HUD's assisted housing programs to provide any individual or family applying for occupancy in HUD-assisted housing with the option to include in the application for occupancy the name, address, telephone number, and other relevant information of a family member, friend, or person associated with a social, health, advocacy, or similar organization. The objective of providing such information is should the applicant become a tenant, this contact information will facilitate contact by the housing provider with this identified individual, to assist in providing the delivery of any services or special care to the tenant and to assist with resolving any tenancy issues. Comments are due June 18, 2009.

 

Guidance on Pest Management PIH Notice 2009-15 was issued May 18 and provides guidance on pest management. PIH Notice 2009-15 extends previous notices, PIH 2008-24 and PIH 2007-12 for another year.

Funding and Leasing Utilization Tool HUD's Office of Housing Choice Vouchers has developed an excel spreadsheet to help housing authorities manage their Housing Choice Voucher program. It is an example of a PHA's estimate of the number of units it can afford to support on its HCV program between now and the end of the calendar year. Because it is in an Excel format with fields that can be modified, you can save a copy for yourself and using your PHA's 2009 figures, you can analyze your program's utilization. (Do not change cells that are populated with a formulas - only make changes to those cells with enterable figures, such as Unit Months Leased, etc.). This can be a great tool for your reference at any time, as to where your program is at for maximizing the number of households your PHA may assist within your ACC and budget authority. Check it out! Office of Management and Budget (OMB) Implementing Guidance for Recovery Act Awards On April 23, 2009 OMB published a Federal Register notice providing additional guidance for agencies receiving Recovery Act funding. This notice provides guidance on the following Recovery Act requirements: reporting requirements; sub recipients must maintain current registrations in the Central Contractor Registration; Buy American requirements; Wage Rate requirements; and Single Audit Act requirements. Please note that these audits must identify separately the Recovery Act funds. We anticipate additional guidance from Headquarters regarding the Buy American provisions. Please contact our office with any questions you have. This document is effective April 23, 2009 and comments on the interim final guidance must be received by June 22, 2009.

2008 Funding Awards for ROSS Service Coordinators On May 13, 2009 HUD published in the Federal Register a listing of funding awards that were made for 2008 ROSS Service Coordinators. The purpose of the ROSS service Coordinators program is to provide funding to hire and maintain Service Coordinators who will assess the needs of Public Housing residents and coordinate available resources in the community to meet those needs. The ultimate goal of the Service Coordinator is to assist families to increase earned income and move toward economic and housing self-sufficiency. Congratulations to the Denver Housing Authority resident organizations and the Missoula and Butte Housing Authorities for their successful applications.

Capital Fund Recovery Act Competition (CFRC) Notice of Fund Availability (NOFA) HUD has published a NOFA making $995 million of Capital Fund Recovery Act funding available to PHAs. There are four categories under the NOFA with each category having its own thresholds, requirements and performance measures. Round 1 begins for the first three NOFA categories on June 15 and PHAs can submit applications as early as June 1. HUD has scheduled a webcast for Tuesday, May 12 at 12:00 MST to address this NOFA.

Federal Fiscal Year (FFY) 2009 Funding Provisions for the Housing Choice Voucher Program On May 6, 2009 HUD issued PIH Notice 2009-13 (HA) which provides guidance on the 2009 funding process for the Housing Choice Voucher program. Please note the May 22, 2009 deadline date for any PHA applications for any of the $100 million set-aside for PHA allocation adjustments. May 22 is also the deadline date for PHA requests for higher administrative fee rates. See page 9 of the notice.

Update on 2009 Notice of Funding Availability (NOFA) Requirements On April 16, 2009 HUD published a notice in the Federal Register addressing changes to the General Section and Policy Requirements of HUD's 2009 NOFA process. HUD will allow additional methods for applicants to submit applications. Specific submission requirements will be spelled out in individual program NOFAs. In addition, HUD has made changes to conform to Executive Order 13202 - Use of Project Labor Agreements for Federal Projects.

Denver, Colorado Fair Housing FIRST Accessibility Training HUD's fair Housing Accessibility FIRST program is conducting a training session on June 11, 2009. The training will cover Fair Housing Accessibility Requirements; Common Design and Construction Violations and Solutions; and Making Housing Accessible Through Accommodations and Modifications. Asset Management Training Sessions HUD is sponsoring ten asset management conferences throughout the country to provide information to PHAs on key asset management concepts. The first seminar will be held May 27, 28, and 29 in Washington, D.C. Additional conferences will be held through October 2009 in Atlanta, Boston, Chicago, Dallas, Las Vegas, Newark, San Francisco, St. Louis, and Seattle. The hotels and dates for the remaining conferences will be announced shortly.

03/17/09 Project-basing HUD-Veterans Affairs Supportive Housing Vouchers (VASH) On March 16, 2009 HUD issued PIH Notice 2009-11 (HA). This notice provides guidance to PHAs who may be interested in project-basing a portion of their VASH vouchers. Our office would appreciate receiving a copy of any proposals submitted to headquarters.
  HUD Waivers Granted On March 17, 2009 HUD published a Federal Register notice identifying all of the waivers granted during the fourth quarter of calendar year 2008. The waivers granted for the Public and Indian Housing programs start on page 11455.
 03/11/09 HUD Computer Matching Program with Social Security Administration (SSA) On March 11, 2009 HUD published a Federal Register notice regarding a computer matching program between HUD and SSA. HUD programs covered by the computer matching include the Low Rent Public Housing and the Housing Choice Voucher programs. The comment due date is April 10, 2009. The computer matching is expected to begin April 10, unless comments are received which will result in a contrary determination, or 40 days from the date a computer matching agreement is signed, whichever is later.
  Calendar Year 2009 Operating Fund Appeals PIH Notice 2009-10 was published March 5, 2009. This notice provides guidance on the submission of 2009 operating fund appeals which must be postmarked by May 15, 2009 and submitted to HUD Headquarters with a copy to the Field office.
  Using Energy Star to Promote Energy Efficiency in Public Housing PIH Notice 2009-9 was issued March 5, 2009. This notice updates guidance encouraging Energy Star as the standard for public housing agencies.
  2008 Public Housing Family Self-Sufficiency Grants On March 5, HUD announced the recipients of 2008 Public Housing FSS grants. Nearly $12 million in grants were made to 207 public housing agencies (PHAs) across the nation. Congratulations to the Region 8 PHAs that had successful applications! Keep up your good work on working with residents to achieve economic independence and housing self-sufficiency.
03/03/09 Annual Financial Statement Electronic Filing with HUD By March 31, 2009, over 30,000 HUD Business Partners in our Multi-Family, Public Housing Authorities and Lender program areas will submit annual financial statements through HUD's Secure Systems over the internet. For many, this year's annual submission will be the first time since last year that they have logged into and used Secure Systems. That means a significant number of filers will need to have their User IDs reactivated by the REAC Technical Assistance Center, and/or their passwords reset, before they can submit this year's financial statements. Please do not wait to the last minute to get any passwords reactivated.
  2010 Budget On February 26, 2009, President Obama announced his proposed budget for 2010. The proposed budget allocates $47.5 billion for the U.S. Department of Housing and Urban Development (HUD). The budget proposes increased funding for the Housing Choice Voucher (HCV) program as well as legislative reforms for the HCV program.
  HUD-DOE Partnership to Help Working Families Weatherize Their Homes On February 27, 2009 HUD and Department of Energy (DOE) announced a major partnership between HUD and DOE that will streamline and better coordinate federal weatherization efforts to make it much easier for families to weatherize their homes and spur a new home energy efficiency industry that could create tens of thousands of jobs.
  The American Recovery and Reinvestment Act of 2009 (ARRA) ARRA was signed into law on February 17, 2009. ARRA includes $13.61 billion for projects and programs administered by HUD, including $4 billion to be made available to public housing authorities (PHAs). $3 billion currently is in the process of being distributed to PHAs. PHAs need to check HUD's web page for requirements and updates regarding use of ARRA funds.
02/25/09 DHAP-Ike Forms On February 25, 2009 HUD published in the Federal Register a Notice of Proposed Information Collection regarding 2 DHAP-Ike forms: the DHAP-Ike Disaster Rent Subsidy Contract (HUD-5251) and the DHAP-Ike Grant Agreement (HUD05256). Public comments are due by April 27, 2009.
  Extension of the Disaster Voucher Program (DVP) On February 24, 2009, HUD issued Notice PIH 2009-8 (HA)which extends DVP until December 31, 2009. Previously, DVP was slated to end February 28, 2009, but there is still remaining funding to carry the program longer.
02/19/09 12/31/08 SEMAP Submission Reminder All 12/31/08 public housing authorities (PHA) are reminded that your SEMAP certifications are due by March 1, 2009. These submissions are made electronically in PIC. In most cases it is the PHA executive director that is authorized to make this submission. Please note that if you have not accessed PIC within the last 90 days you may have been inactivated in PIC. Your status will need to be reactivated in PIC (which your PIC Systems Coordinator should be able to do) for you to make your SEMAP submission. Please do not wait to the last minute to do this. Also, please make sure you access PIC on the same day you reactivate your access.
  MASS Certifications Our office has received several inquiries regarding submission of MASS certifications by public housing authorities (PHAs). We remind PHAs that on August 21, 2008 HUD published a Federal Register notice informing PHAs that MASS and RASS submissions are not required during the PHAS transition year for 6/3/08, 9/30/08, 12/31/08 an 3/31/09 PHAs.

  One Stop Shop for Section 504 Information HUD's Office of Fair Housing and Equal Opportunity has a one-stop web page with valuable information on Section 504. Section 504 provides that no qualified individual with a disability should, only by reason of his or her disability, be excluded from the participation in, be denied the benefits of, or be subjected to discrimination under any program or activity receiving Federal financial assistance.
  Federal Agencies Develop Web Site to Strengthen Youth Programs The Interagency Working Group on Youth Programs, a collaborative effort of 12 Federal departments and agencies, including HUD, has launched a new web site. This site provides targeted information to help youth-serving organizations and community partnerships plan and implement effective youth programs.
02/17/09 Emergency/Disaster Preparedness Plan Training The U.S. Department of Housing and Urban Development in conjunction with the Federal Emergency Management Agency and the Colorado Division of Emergency Management will provide a one-day training session (at no cost) for property managers of multifamily apartments and public/Indian housing authorities on the importance and the "how to" of developing a local property Emergency/Disaster Preparedness Plan. This session will be March 12, 2009 at the HUD office in Denver and will be broadcast to the HUD Field Offices in the Rocky Mountain region so interested clients in Montana, North Dakota, South Dakota, Utah and Wyoming can participate.
02/12/09 Delay in Effective Date of Refinement of Income Final Rule On February 11, 2009 HUD published a Federal Register notice informing the public that HUD is considering a temporary 60-day delay in the March 30, 2009 effective date for the final rule that was published on January 26, 2009. The February 11, 2009 notice also clarifies that the final rule does not apply to individuals in mixed families, who do not contend eligible immigration status under HUD's noncitizen regulations; nor does it interfere with existing requirements relative to proration of assistance or screening for such families. Comments are due by March 13, 2009.
  Voucher Management System (VMS) Data Input Reminders PHAs are reminded that monthly VMS reporting in now required for your Housing Choice Voucher program. VMS will be open February 15-22, 2009, for reporting of January data. PHAs are also reminded that February 17, 2009, is the deadline for manually entering into the Comments section of VMS your agency's information regarding PHA-owned units leased during July, August, September, October, or November 2008. The Financial Management Center provided guidance on this in a February 6, 2009 email. PHAs are also reminded of the February 20, 2009 due date for submitting requests for partial month administrative fees for 2008. PHAs were provided guidance on this in a February 5, 2009 letter. Finally, PHAs are reminded of the February 27, 2009 due date for reviewing VMS data for the period January 1, 2005 through December 31, 2008. This review is critical for determining 2009 Housing Choice Voucher funding levels. If you have any questions, please contact your Financial Management Center Financial Analyst.

02/09/09 Veterans Affairs Supportive Housing (VASH) Webcast A webcast on the VASH program is scheduled for February 10, 2009. Please note that this HUD web page has an incorrect date of February 5. The webcast is scheduled for February 10.
  Enterprise Income Verification (EIV) and 1/27/09 Refinement of Income Final Rule Webcast HUD will provide webcast training on February 11 and 12, 2009 regarding new EIV requirements as well as the Refinement of Income Rule that was issued on January 27, 2009. Topics to be covered in this webcast include:
    1. Mandated use of the EIV system
    2. SSN disclosure of all household members, regardless of age
    3. Required verification of U.S. Citizenship or nationality
    4. Changed definition and determination of annual income
Please be advised that the EIV training agenda has changed. Different information will be covered on each day. Day 1 is for all staff. Day 2 is for those who have never used EIV or participated in EIV system training, or for those who need a refresher on the EIV functionalities and how the system works.

01/27/09 Final Rule Requiring Use of HUD's Enterprise Income Verification (EIV) System On January 27, 2009 HUD published a Final Rule requiring housing authorities to use HUD's EIV system when verifying employment and income of program participants. This Final Rule is effective starting March 30, 2009.
  2009 Capital Fund Data Certification HUD has posted guidance and a schedule on its web page for public housing authorities (PHAs) to complete the 2009 Capital Fund certification process. PHAs have until February 20, 2009, to complete this process. Please review the guidance posted on the web page very carefully and if you have any questions, please contact your Facilities Management Specialist.
  DHAP Conversion Frequently Asked Questions (FAQ) HUD has posted FAQs about the DHAP conversion program on it web page. The DHAP program is scheduled to end February 28, 2009.
01/26/09 Increased Terms of Energy Performance Contracts On January 26, 2009 HUD published a Final Rule in the Federal Register that provides a maximum term of 20 years for energy performance contracts. Existing energy performance contracts can be extended to 20 years without reprocurement. The effective date for this Final Rule is February 25, 2009.
  Housing for Older Persons Act of 1995 (HOPA) On January 26, 2009 HUD published in the Federal Register a Notice of Proposed Information Collection regarding HOPA. Comments on the proposed information collection are due by March 27, 2009.
  2008 Housing Choice Voucher (HCV) Family Self Sufficiency (FSS) Program Awards On January 23, 2009 HUD published in the Federal Register the 2008 HCV FSS funding awards. Congratulations to the Rocky Mountain region housing authorities that received funding.

On January 22, 2009 HUD published a notice of proposed information collection in the Federal Register. It is proposed that housing providers would provided applicants for housing assistance the option of including in the application for assistance the name and contact information for an individual who may assist the applicant with any special services or care needed. Comments are due March 23, 2009.
01/21/09 Unaudited Financial Statement Submissions for PHAs HUD has posted a tool and guidance for PHAs for the submission of unaudited financial statements. PHAs with fiscal years ending (FYE) 6/30/08, 9/30/08 and 12/31/08 will have until April 13, 2009 to submit financial statements. PHAs with a 3/31/09 FYE will have until June 30, 2009 for submitting unaudited financial statements. This submission requirement is applicable for both the Low Rent Public Housing Program and the Housing Choice Voucher Program.

Rental Housing Integrity Improvement Project (RHIIP) Mailing List HUD has created a new listserv to keep PHAs and interested stakeholders abreast of the latest and greatest on RHIIP, EIV, training opportunities, guidance, technical assistance, etc. PHAs are encouraged to sign-up for this new mailing list. Administrators of the Public Housing and Housing Choice Voucher programs will receive updated information, guidance, technical assistance and notice of training opportunities to improve effectiveness and efficiency in administering PIH rental assistance programs. Also, administrators will receive guidance and information related to the reduction of improper subsidy payments and improving the integrity within the PH and HCV programs.

Enterprise Income Verification (EIV) and Security Awareness Training HUD's EIV and Security Awareness training is scheduled for February 11 and 12, 2009. PHAs won't want to miss this training! HUD will publish the Final Rule: Refinement of Income and Rent Rule in January. In the February training HUD will provide PHAs with guidance on effective implementation of the following new requirements:
  1. Mandated use of the EIV system
  2. SSN disclosure of all household members, regardless of age
  3. Required verification of U.S. Citizenship or nationality
  4. Changed definition and determination of annual income

Capital Fund, Operating Fund and Housing Choice Voucher Program Fungibility for PHAs in Louisiana and Mississippi On January 16, 2009 HUD issued Notice 2009-3 (HA) which extends through 2009 the authority granted to eligible PHAs in Louisiana and Mississippi to combine program funding.

Calculation of Operating Fund Program Transition Funding Amounts for 2009 On January 16, 2009 HUD issued Notice PIH 2009-2 (HA). This notice provides guidance regarding the calculation of transition funding under the Operating Fund Program for 2009. This information is especially important for decliner PHAs subject to transition funding for 2009.

Eminent Domain Procedures Notice PIH-2009-01 (PHA) was issued January 2, 2009. This notice provides guidance on the factors HUD will consider in determining whether to consent to the taking of public housing property by a governmental body using eminent domain authority.

01/06/09 Webcast for HUD's 2009 Notices of Fund Availability (NOFAs) for Discretionary Programs On Wednesday, January 7, 2009 HUD will host a webcast from 11:00AM to 1:00 PM EST. The broadcast will address changes to the NOFA process; estimated timeframe for release of NOFAs; electronic registration requirements, and changes to the logic model for 2009.
